
Justice shows his indulgence is running out in the case of the beach bar on Elia beachV Mykonos.
Last week, the Aegean Decentralized Authority approved two “old” demolitions on Elia Beach: one of the two involved a Tiki bar. In fact, the costs were borne by the shipowner, at the expense of which the demolition of an illegal building on the beach of Mersina took place. The demolition was supposed to take place today.
But on June 2, the Piraeus Administrative Court of Appeal, after an appeal by the property owners, issued a temporary order, “freezing” the execution of the demolition.
The court gave a time limit of 15 days “to make possible the demolition of the buildings, as well as the removal of the materials that will result from this, with the same means and at the same costs” (p. Arbitra).
Although the period specified by the court is short, the decision is noteworthy in that the law provides for a certain period (10 days) from the date of drawing up the demolition protocol (i.e. in 2021) so that the arbitrator can eliminate the structures of the building itself.
However, the Aegean appeals attorney, Odysseas Tzorbatsoglu, visited the place this morning to find out if the owner of the bar will keep his promise and if the bar will work as usual. As it was established, the removal of equipment and dismantling of structures has already begun.
