New Mexico prosecutors have decided to drop criminal charges against actor Alec Baldwin in the 2021 death of cameraman Galina Hutchins on the set of the movie Rust, Baldwin’s lawyers said on Thursday, according to Reuters.
Prosecutors dropped charges against Alec Baldwin in the fatal shooting of a cameraman after new evidence showed the gun the actor was holding and firing was fake, a person familiar with the matter said.
Evidence showed the Colt .45 revolver Baldwin fired had been modified after it was manufactured, and prosecutors could no longer prove it could not fire a bullet without the trigger being pulled, the man said.
In January, 65-year-old Baldwin was charged with involuntary manslaughter. Santa Fe prosecutors charged him with criminal negligence when the gun he was rehearsing a scene with fired and discharged a live bullet that killed Hutchins and injured director Joel Souza.
In February, the actor pleaded not guilty, and prosecutors dropped charges of aggravated battery against the actor.
“We are pleased with the decision to dismiss the case against Alec Baldwin and call for a proper investigation into the facts and circumstances of this tragic accident,” said Luke Nikas and Alex Spiro, attorneys for Alec Baldwin.
In late March, assistant director Dave Halls was sentenced to probation after pleading guilty to negligent use of a deadly weapon. Prosecutors said he was responsible for ensuring security on the set.
Hannah Gutierrez-Reid, the film’s gunsmith, is also charged with involuntary manslaughter and has pleaded not guilty.
