
Dave Halls, the assistant director of the film “Rust”, was sentenced on Friday for the death of cameraman Galina Hutchins. This is the first sentence for the death of 2021, which shook Hollywood, according to Reuters.
A New Mexico judge recently accepted a plea deal on a charge of negligent use of a deadly weapon.
David Hall, 63, was charged with negligent use of a deadly weapon in connection with a shooting on the set of a western in Santa Fe in October 2021. Halls handed Alec Baldwin the Colt 45 revolver he had been firing during practice, shooting Hutchins. Attorneys for Hall and Baldwin said neither of their clients knew the firearms contained live ammunition.
During a video plea Friday, Halls said he did not contest the charges. He answered questions from the judge but did not make any statements about the incident.
“He, like many others, is extremely traumatized and marked by guilt and many other feelings, why could I have done better, how could I have changed anything?” his attorney, Lisa Torraco, said during the hearing.
Torraco asked the judge to delay sentencing and argued that his role as a safety coordinator was not to control how people handled guns, but to ensure safe encounters.
Prosecutor Kari Morrissey argued that Halls, as the security coordinator, was responsible for ensuring that firearms were free of live ammunition and that there had been safety issues on set in the past involving the firing of firearms.
District Judge Mary Marlo Sommer sentenced Hall to six months of unsupervised probation, a $500 fine, 24 hours of community service and a firearms safety course.
Baldwin and the film’s gunsmith, Hannah Gutierrez-Reed, have been charged with two counts of involuntary manslaughter against Hutchins. Weapon upgrade fees for both were removed at the end of February.
Halls, an industry veteran who has worked on more than 80 productions, including The Matrix Reboot and The Raven, was the only member of the Rust crew to accept the deal. Prosecutors said he cooperated.
It remains unclear whether he will testify for the prosecution at a preliminary hearing in May, where Marlowe Sommer will decide whether there is probable cause to charge Baldwin and
gunsmith Hannah Gutierrez-Reid.
Baldwin pleaded not guilty to the manslaughter charge. The actor said he relied on experts – Gutierrez-Reed and Halls – to make sure the firearms were
safe to use.
Gutierrez-Reid, who was in charge of firearms safety and training, also pleaded not guilty, her attorney said.
