After complaints from Financial Prosecutor’s Office two years ago also conducted an audit for the famous contract 717 ERGOSEwith the aim of improving the safety of the railway network.

The corresponding contract was signed in 2014 and although the project was supposed to be completed in two years, it is still under consideration.

Two years ago, the Financial Prosecutor’s Office received not one, but a series of complaints from OSE, after they had previously been sent to then-corruption prosecutor Eleni Toulupakis. First of all, they dealt with issues of infidelity. As expected, the Financial Prosecutor’s Office decided to conduct a preliminary review, in which it applied to the National Transparency Agency with a request to audit the contract. The order for the audit of ERGOSE was issued in 2019, and the EAD audit report was submitted to the financial prosecutor’s offices on September 30, 2021.

The opinion is 185 pages long and, according to the EAD’s official response to question “K”, it states, among other things, the following:

A) Failure to comply with mandatory deadlines for approval of studies.

b) Errors are mainly in the remote administration of Athens and Larissa at the stage of compiling tender documentation.

V) Low and disproportionate to the contractual terms the progress of work, due to the untimely fulfillment of contractual obligations by the contractor.

The National Transparency Authority proposed disciplinary proceedings against the ERGOSE executives, as well as a fine of 1.3 million euros. However, the Financial Prosecutor’s Office decided to initiate a case, because, as they explain in legal circles, there were no signs of adultery, which was subject to a preliminary check. After a recent order from Dodjak, the case was reopened.

European Prosecutor’s Office

A few months later, the European Prosecutor’s Office re-examined the contract and those who acted as an intermediary from its signing in 2014 until today. Her involvement was the result of a complaint she received in May 2022. After all, Contract 717 is 85% community funded.

The European Prosecutor’s Office sent a request to the Greek Prosecutor’s Office asking if there was a pending case in the same case, i.e. Contract 717. The response came five months later, in October 2022, when the Economic Prosecutor’s Office informed their European counterparts that their the previous investigation was shelved. The investigation by the European Prosecutor’s Office is ongoing, and the leaders of ERGOSE and the consortium companies are expected to be called to testify in the next 24 hours.
