Neither Attorney General Gabriela Scutea nor DNA Chairman Krin Bologa were proposed by the Minister of Justice for a new mandate. Prosecutors Alex Florin Florenta and Marius Jonuts Wojniag are the proposals announced on Monday by Catalin Preda for the leadership of the General Prosecutor’s Office and the DNA.

The proposals made by the Minister of Justice regarding the positions of the Prosecutor General and Chief Prosecutor of the DNA are as follows:

• Alex Florin Florence for Attorney General
• Marius Ionuts Voyniag was appointed to the position of chief prosecutor of DNA

The offer for the position of chief prosecutor of DIICOT will be announced in the next period after the analysis of candidates is completed, the Ministry of Justice reports.

In a press release sent Monday, the justice minister says that when analyzing the candidates and formulating the proposals, “we took into account the numerous data and documents in the file of each candidate, as well as the demonstrated qualities and knowledge. during each interview, on the basis of some combined criteria that relate to both the career, experience, experience, personal professional, managerial and psychological qualities and characteristics of the candidates, the prospective needs of the institutions to which they have applied, and their effective functioning forecasts in within the framework of the State Ministry”.

• “The criteria and primary arguments that were taken into account were professional experience and expertise, opened cases, previous results obtained during the career.

• If considered solely from the point of view of each candidate, in relation to the results obtained in previous positions, the possible offer may constitute and implicitly legitimately be considered by him, and by the public or a part of it, as a professional reward or an implicit automatic approach.
• Every institutional leader who receives a leadership mandate at a given time must absolutely do everything in his power to achieve maximum institutional effectiveness, while addressing and addressing every institutional vulnerability or weakness in every historical period of the mandate, preparing the institution for the next one. stage of evolution and for modern and future challenges.

He says that “it is important that each unit of the prosecutor’s office is headed and represented by a prosecutor whose competence and professional experience have already been demonstrated with certain and visible results, through complex cases that have been used in his career, by a leader who has a clear vision of the mission of the headed institutions, the ability to explain and correctly formulate this mission, reporting to the first and last proportion of the law, the ability to generate and the power of an institutional culture of professionalism and legality, which knows the resources of each institution and how they can be distributed more effectively, develops directions for the development of institutional capacity and increasing the efficiency of the managed institution, has the courage and ability to modernize and improve its activities, mobilize and improve the collective of prosecutors, in accordance with the current and possibly future powers provided for by law, regarding relevant strategies, the sphere of influence with institutional actions, current and prospective risks for society tva, represented by the accelerated dynamics of the criminological phenomenon, not least, the need for general coordination of the actions of the Ministry of Public Affairs, PÎCCJ, DNA and DIICOT”.

According to him, each proposal “must be considered within the framework of these criteria and it is desirable that it be presented from an institutional point of view, not as a routine dispute resolution based on interviews between a few already recognized professionals, and even less as a professional invalidation of the unselected candidates, who are and will remain in their turn, along with the nominated prosecutors, distinguished by the high value of public service.”

Motivated proposals of the Minister of Justice are submitted every month to the department for prosecutors of the Central Committee of Ukraine for the provision of a motivated advisory opinion no later than 30 days from the moment of receipt of the request of the Minister of Justice.

Two candidates for the position of Prosecutor General of Romania – Gabriela Scutia and prosecutor Alex Florin Florenza from the Office for the Investigation of Organized Crime and Terrorism – held an interview on February 20 before a commission headed by Justice Minister Catalin Preda.

In the case of a negative advisory opinion issued by the Section for Prosecutors of the CSM, the law provides for the Minister of Justice to organize a new interview exclusively with the candidate who received a negative opinion.

After the interview, the Minister of Justice can continue the procedure by submitting to the President of Romania a proposal for the appointment to the executive position together with all relevant documents, or withdraw the proposal by starting a new selection procedure within a maximum of 60 days from the withdrawal of the proposal.
