
On Wednesday, the Government adopted the Methodological Rules for the Application of Law No. 421/2002 on the legal regime of unattended or abandoned vehicles on lands belonging to the state or private property of the state or administrative-territorial units, according to Agerpres.
According to the press release of the executive power, the normative act approves the methodological norms of the application of Law No. 421/2002, updated in accordance with the legislative changes that occurred during the validity of the said law, and cancels the methodological norms. issued in 2003.
Thus, normative decisions compatible with the norms of the current legislation are preserved, to which the following norms are added:
- establishing the legal meaning of the term “vehicle” with a clear clarification that it is also valid in the context of the application of Law No. 421/2002, and not only in the application of methodological norms;
- regulation of the powers of mayors and heads of police units to conclude protocols for establishing specific methods of cooperation for the purpose of applying the provisions of Law No. 421/2002;
- directly regulating the official notification of the presence of an ownerless or abandoned vehicle in public access together with the notification received from any person, as well as the ways in which these notifications are received by the authorities;
At the same time, regarding the protocol, it is provided that it is signed only by a witness, or with the production of photographic plates, which can be used to obtain information about the condition of the vehicle, and must contain: the date and time of the performance.
Also, with regard to vehicles registered at the level of the Ministry of Internal Affairs, the Ministry of Internal Affairs or the Ministry of Internal Affairs and Communications, the project provides that the mayor sends a copy of the statement declaring the vehicle as ownerless or abandoned to the body that carried out the registration or registration.
The regulatory act also establishes that the procedure for the capitalization of vehicles transferred to the ownership of an administrative-territorial unit is carried out by direct sale or sale at an auction in accordance with the procedure for the assessment and capitalization of seized property operating at the level of local fiscal bodies, which is applied accordingly.
