Seville Scheide, the former PSD development minister in Ponta’s government, was finally acquitted on Tuesday in the Belina case, in which she was referred to the DNA court for abuse of office.

The decision was made by the Bucharest Court of Appeal, which upheld the decision made by the court in April, only changing the basis on which this decision was made – if the court referred to Art. 16 para. 1 liter b) Criminal Procedure Code (the act is not provided for by the criminal law or was not committed due to the guilt provided for by the law), the appeals court applied Art. 16 para. 1 liter a) Cpp (the fact does not exist).

It is about the President of the Teleorman District Council, Adrian Yonuts Gadea, Yonela Stoyan (formerly Vasile), MDRAP director at the time of the events. Mariana Sanda Georgiou, chief assistant registrar at the Cadastre and Real Estate Advertising Bureau of Alexandria and Rodik Gush, assistant registrar in the same office.

The judges also decided to cancel preventive measures in their case.

DNA accusations in the Belina case

In June 2018, DNA prosecutors ordered the indictment of former PSD minister Sevil Scheide along with four other individuals, including former CJ Teleorman president Adrian Jonutz Gadea.

DNA prosecutors said that in 2013, thanks to the concerted actions of some public officials, parts of Belina Island and Pavla Arm, located in the small channel of the Danube, were illegally transferred from state property to Teleorman County and the Teleorman CJ administration, and after just a few days, the two properties, with an area of ​​278.78 ha and 45 ha, respectively, were illegally leased to a private company, HG 943/2013 was adopted for the transfer of ownership, an individual act that violated a number of legal provisions.

Belina Island was leased by the Tel Drum company controlled by Liviu Dragnia.

Several buildings were erected on the island, including two buildings, a gazebo, pontoons, and a large concrete surface that was used as a helipad.

In fact, during the trial, the pilot revealed that he had transported the former PSD leader Liviu Dragnia several times by helicopter to Belina Island.

  • “We made helicopter flights on Belina Island. At the time, I didn’t know it was an island, rather it was undeveloped land. Went five or six times. On the first flight, I went with the owner of the helicopter and noticed that it was a wild area with high vegetation. He took steps to build a landing pad.
  • I moved Mr. Dragnia to the island, as well as other people, among whom I can mention Mr. Adrian, who worked for SPP, then was an advisor. I kept in touch with Adrian, there were times when I left Băneasa and no one entered. (…)
  • These flights took place in 2016-2017, during the election campaign. We left Mr. Dragnea on the island and it took a while before we picked him up. This platform was built specifically for landing helicopters.
  • The discussion was to clear the site and this site was built. The first thing we saw was that the vegetation was very tall and then we were told to land on this platform. (…) Of course, I did not deal with my own transport for recreation, everything was connected with Liviu Dragnia,” the pilot said in March 2020.

According to the investigation, Belina Island and Pavla Arm, located in the small channel of the Danube, are part of the state property by law and the Constitution, so they cannot be transferred. owned by the county council by government decision, but only by law.

  • “In particular, during the period from September 23 to December 2013, as Secretary of State, the defendant Sevil Scheide initiated, substantiated, entered into the approval scheme and presented to the government for approval the draft decision (which will be called HG 943 /2013), because and also signed by him as to the initiator, an explanatory note.
  • On the basis of these documents, the transfer of part of Belina Island and Pavel Arm into the public domain of the Teleorman District and the management of the Teleorman District Council was approved. This is under the conditions under which the defendant knew that in this way she was drawing up documents that violate a number of provisions of the law,” DNA said.

According to prosecutors, the Ministry of Public Finance and the Ministry of Justice had already made observations during the approval cycle that signaled aspects of illegality regarding the transfer, aspects that were ignored.

Prosecutors also alleged that Ionela Stoyan (formerly Vasile), as the director of MDRAP – legal management, relations with the parliament and international relations, supported illegal actions, because she did not make notes on the observations made by two ministries that approved the parties (Ministry of Justice and the Ministry of Public Finance) did not comply with the norms regarding the reconciliation scheme and contributed to the misrepresentation of the same ministries with regard to pre-existing lease contacts.

  • “It should be noted that prior to these actions, the territories on Belina Island and Pavla Arm were leased under contracts to a private company and one person.
  • In order not to draw the attention of the central state administration to the existence of the interests of this private company in Belina Island and Pavla Arm, it was desired to obtain some “clean” extracts from the land register, which contain lease agreements. with the administration, Romanian waters and this commercial company do not appear as parties,” explains DNA.

DNA reported that this activity was coordinated by Adrian Ionuc Gadea, president of CJ Teleorman, who asked the National Administration “Apele Romanian Waters” to approve the transfer, ignored the presence of extracts from land deeds that contained the obligations of a private company, coordinated and replaced them with some with new excerpts from land deeds, which no longer provided for lease agreements, and he appropriated with his signature a draft justification, in which it is not true that it is stated that the buildings are not encumbered:

  • “Under the pretext of correcting a significant error, the defendants Georgiou Mariana Sanda and Guša Rodik, as registrars, in violation of the law, in accordance with some provisions of the Civil Code, drew up and signed documents on the basis of which the records made regarding the conclusion of lease agreements with this private company were canceled.”

In addition, Adrian Gadea was accused of promoting the draft decision of the county council to transfer Belina Island and Pavel Arm to the ownership of Teleorman County and under the administration of CJ Teleorman and initiated the draft government decision to preserve the legality of the individual project, which would become HG 943/2013, although he knew on violation of legal provisions that regulate the rules of legislative technique. He also informally sent draft documents from CJ Teleorman to MDRAP, some unsigned, in the absence of a decision by the county board.

  • “During January 2014, following the adoption of GD 943/2013, which confirmed the transfer of Belina Island and Pavel Ark to the ownership of Teleorman County and to the administration of the County Council, as President of Teleorman CJ, the defendant Gadea Adrian Jonutz took the following steps to, based on HG 943 /2013 to create the possibility of concluding three lease agreements between CJ Teleorman, on the one hand, and a commercial company and another person, on the other.
  • The contracts, the object of which are parts of Belina Island and a branch of the Pavel Danube River (with a total area of ​​80 hectares), were concluded for a period of 10 years, without the organization of an auction and without the initiation and completion of the procedure for issuing a decision by the regional council,” DNA said.

In the course of the investigation, it was revealed that as a result of the actions committed by Sevil Scheide, Adrian Gadea and Ionela Stoian, the Romanian state suffered damages in the amount of 3,237,800 lei, which is the total value of two immovable assets that came out of his inheritance, to which he adds 248,126,334 lei, which is the equivalent of 50% of the sum of three lease agreements, which should have been charged to the state budget in the period from January 16, 2014 to April 23, 2018.

The prosecutors also established the damage caused to the National Administration “Apele Romanian Waters” in the amount of 248,126 lei, which is equivalent to 50% of the sum of the three leases that this institution had to collect as the owner of the right to manage the buildings.

  • “Accordingly, Teleorman County received an inheritance benefit of 3,237,800 lei, representing the total value of the two immovable assets included in his inheritance, and an inheritance benefit of 496,252,668 lei, which is equivalent to the amount coming from lease agreements, the burden of the building “, DNA recalled.
