The government in Warsaw is refusing to implement measures adopted by the European Court of Human Rights (ECHR), the European court announced on Thursday, a new episode in the conflict between Poland and various European institutions over the rule of law and justice reform.

On December 6, the ECtHR passed emergency measures, called “provisional measures”, requiring the Polish government to suspend the transfer of three judges from the Court of Appeal in Warsaw pending the announcement of the final decision of the European Court referred to in the case. this case, writes Agerpres.

But “the Polish government recently informed the Court that the interim measures will not be respected,” the ECtHR said in a statement, without mentioning what it could do in this situation.

According to the Polish government, temporary measures “are not a binding solution” and some articles of the European Convention on Human Rights are incompatible with the Polish Constitution.

Reforms in the judicial system implemented by the Polish conservative government in recent years have brought him several judgments at the ECtHR, where 323 cases related to these reforms or their consequences are currently pending.
