
The National Broadcasting Council (CNA) published on Thursday a list of television stations that must be broadcast by cable television providers in 2023, writes Agerpres.
From that a list that can be found on the CNA website, are part of the programming services of the Romanian Television Society intended for the public in Romania, television services whose retransmission obligations are established by international agreements to which Romania is a party: TV 5 MONDE and Moldova 1, which was postponed until the resolution of the “Teleradio-Moldova” Company ” regarding the broadcast of the “Moldova 1” program on the territory of Romania; program services, free for retransmission and without technical or financial conditions, of private broadcasters – in the order of the annual audience index for 2022.
The list also includes local and regional programs owned by private broadcasters under the jurisdiction of Romania and programming services intended for national minorities with a weight of more than 20% owned by private broadcasters under the jurisdiction of Romania (ERDELY TV – regional program, Alba, Arad, Bihor counties , Bistriţa-Năsăud, Braşov, Caraş-Severin, Cluj, Covasna, Harghita, Hunedoara, Maramureş, Mureş, Satu Mare, Sălaj, Sibiu and Timiş, in Hungarian, intended for the Hungarian minority in Romania).
At the same time, the list of “mandatory” includes the state services of the Romanian Language Society; national and local private broadcasting programs. They can be accessed from the list of audiovisual licenses for terrestrial, satellite and electronic communications networks for program broadcasting.
The principle of “mandatory transmission” is governed by Article 82 of the Law on Audiovisual Media and requires cable operators to rebroadcast certain television programs. This principle does not apply to DTH operators.
Article 82, paragraph 1 of the Law on Audiovisual Means provides that “any distributor retransmitting program services through electronic communication networks shall include in its offer the program services of the Romanian Television Company intended for the public in Romania, as well as other program services , free for retransmission and without technical or financial conditions, private broadcasters under the jurisdiction of Romania within 25% of the total number of program services distributed through the relevant network, as well as television services whose retransmission obligations are established by international agreements to which Romania is a party . The decisive criterion for private broadcasters is the decreasing order of the annual audience index.”
At the same time, in the same article, the law provides: “The Council annually reviews the list of television programs that must be received during retransmission, and publicly reports on changes in the list. The distributor is obliged to receive and provide users with additional services related to program services, provided for in paragraph (1), respectively, accessibility services that provide appropriate access for users with disabilities to data that allows the provision of connected television services, as well as to the electronic network of programs, if they have been provided by the broadcaster. The Council will review the list of additional services, related to the software services provided for in paragraph (1), once every 5 years.”
