
According to News.ro, on the agenda of Wednesday’s meeting, the government has an emergency resolution aimed at extending the validity of the COVID certificates, which emphasize vaccination, testing and treatment for COVID-19, beyond December 31, 2022.
According to the official announcement of the Government, on the agenda of the meeting on Wednesday is a draft of an emergency order on amendments to Art. 1 paragraph (12) of the extraordinary government order no. 68/2021 on taking measures to implement a European framework for the issuance, verification and acceptance of the European Union digital certificate in relation to COVID in order to facilitate free movement during the COVID-19 pandemic.
National legislation currently provides that certificates issued to facilitate free movement during a pandemic are valid:
a) test certificates, 48 hours for an express antigen test and 72 hours for a nucleic acid amplification test;
b) certificates of recovery, 180 days from the date of the first positive test result for SARS-CoV2, registered in the computer platform “Korona-forma”;
c) vaccination certificates, until December 31, 2022.
European institutions have decided that the validity period of vaccination certificates has been extended beyond 12/31/2022.
“In this sense, it is necessary to initiate this regulatory act to ensure consistency of national legislation regarding the method of issuing, verifying and accepting EU digital certificates in relation to COVID and the date until which they are issued and valid. Emergency adoption is required for the Romanian State, through the competent institutions, to take the necessary measures to immediately implement the modification of the functionality of the integrated IT system for the issuance and verification of EU digital certificates in relation to COVID-19, so that the certificates issued and those to be issued will be valid until 30.06.2023, the date established by Regulation (EU) No. 2022/1034”, the Explanatory Note states.
According to the initiators, “the non-acceptance of this project in the form of a draft emergency resolution will lead to negative consequences for Romania regarding the obligation to apply European acts, given the fact that the IT system is unworkable without the necessary changes.”
“In addition, after December 31, 2022, it will be impossible to carry out a verification procedure regarding the recognition of certificates issued by other states,” the cited document also states.
