Additional insurance company compensation for damage caused to Mr. Alexandros Grigoropoulos will be paid by the state after its respective (four) decisions State Council. The High Court awarded €1,562,600 plus legal interest to an insurance company that sued for the recovery of money paid to shopkeepers who suffered from the protracted and violent incidents that took place on 7 December 2008, the murder of the then 15-year-old Alexandros Grigoropoulos. Already the Council of State, by its earlier decisions, which have already been published, has awarded compensation for the damage suffered by the owners of shops in the area as a result of the incidents in question, in the amount of 1,800,000 euros or more.

In this case, the insurance company that filed the appeal lost the first and second instance lawsuits on the grounds that “the violent events of that night and their detrimental consequences are an event that could not have been prevented with the greatest diligence.” Consequently, it was decided by administrative complaints that “the state is not responsible for the unlawful inaction of its (police) bodies and its liability for damages has not been established.” However, the Council of State, Division 1 of the Council of State (Chairman, Vice President Marina Konstantinidou and Rapporteur, State Counselor Hariklia Haralambidou), overturned four decisions of the Administrative Courts of Appeal and upheld the insurance company’s compensation. , pointing out in their rulings that “it is not clear how the police acted during the violent incidents and, in particular, there is no mention of any specific actions that they took to stop encroachments on the property of citizens, and it also does not appear that even some of the perpetrators in arson and destruction were arrested, given that in the decisions of the courts of appeal, the perpetrators appear as “unknown”.

This particular decision is added to a number of administrative justice decisions that compensate citizens for incidents of condemnation of the state, when it is believed that the police did not prevent them by protecting the property of citizens.
