The European Commission decided on Thursday to send a reasoned opinion as part of the infringement procedure against RomaniaBelgium, Austria and Slovenia for the incomplete transposition of the “Directive on the Protection of Whistleblowers” (Directive 2019/1937).
The deadline for the transposition of the Directive by the Member States was December 17, 2021. In January 2022, the Commission sent letters of formal notice to 24 Member States for failing to transpose the Directive and notifying the Commission of transposition measures by the deadline.
In July 2022, the Commission sent reasoned conclusions to the 15 Member States that had not yet notified full transposition.
On Thursday, the Commission decided to send reasoned conclusions to the four Member States that have not yet fully notified the transposition measures.
Romania now has two months to respond. In case of unsatisfactory answers, the Commission may decide to refer these cases to the Court of Justice of the European Union.
context:
Through its monthly package of infringement decisions, the European Commission (the “Commission”) takes legal action against Member States that have failed to fulfill their obligations under EU law. These decisions, which cover different sectors and areas of EU policy, aim to ensure that EU law is properly applied for the benefit of citizens and businesses.
