
The City Hall of Sector 2 won the first court in which a private investor asked the court to oblige the institution to issue a town planning certificate for the construction of a complex of blocks with a maximum height of 28 floors. The court decided that the city hall will not issue a town-planning certificate until the fate of PUZ sector 2 is clarified (PUZ is currently suspended).

The mayor says that the investor tried to intimidate him, but to no avail.
- “Long story short, Mr. Manochehr sued me and then came to the audience with a bunch of famous lawyers hoping to intimidate me.
- I did not let myself be scared and won.
- I am a mayor who wants the development of Bucharest and I believe that by following some clear principles we can have such a developing city where we respect the community, green areas, developers and public authorities.
- But this means, above all, respecting the law and not succumbing to intimidation. It remains as we established: the Radet base is not subject to construction,” Radu Mihayu also wrote.
In particular, on September 12, the Bucharest Court decided to suspend the proceedings until the final resolution of cases No. 9784/3/2022 and No. 27283/3/2020 of the Bucharest Court, aimed at canceling the PUZ Sector 2, the urban planning document, on the basis of which towers can be built in the green zone. The decision can be appealed.

At the former RADET sports base in Floryasca, the businessman of Iranian origin, Manochehr Saadati-Sohi, who became famous in Romania as the manufacturer of Antrefrig pate, wants to build 28-storey buildings.
On the basis of the PUZ Coordinator of Sector 2 of a controversial document, stopped by the court, which allows the concreting of tens of hectares of green areas, the entrepreneur requested on 17.02.2021 to provide him with a town planning certificate for the land. on the building Barbu Văcărescu 275 – 277 – 291 to build a set of blocks from 3S+P+13E + 14 Duplex and 3S+P+27E + 28 Duplex.
Through PUZ Sector 2, the former RADET sports base located in Calea Floreasca and bd. Barbu Văcărescu turns from a green zone (V 3b) into a CB 3.1 area, which means “a sub-zone of the main urban poles that group complex functions”. According to the regulation, urban planning values of POT (Percentage of Land Occupancy) of 70% and CUT (Land Utilization Ratio) of 4 are allowed in this area, and the maximum height is not restricted.
The sports base was reconstructed in 2004.
According to the previous regulations, the sports base is listed in the General Plan with a green code, and the corresponding urban planning indicators are 30% POT, 0.35 PPE and a maximum height of two floors.
The businessman threatened to demand compensation of 200 million euros from the City Hall of the 2nd sector for the fact that the institution does not allow him to build high-rise buildings.
It remains to be seen how this case will turn out and whether the court will overturn the 2nd district’s PAZ, as it did the 3rd and 6th district’s PAZ.
