
Brasov Environmental Protection reports that last week there were reports of persistent odors in several areas of Brasov and its surroundings, which were caused by the application of agricultural fertilizers. The institution says that the introduction of these substances during this period is allowed, “despite the temporary olfactory discomfort”, and the “Ecological Guard” does not have equipment to determine the level of emissions into the atmosphere, and there is no equipment for smelling.
The Environmental Watch of Brasov reports on its Facebook page that “persistent odors that created strong olfactory discomfort” were registered in several districts of Brasov and its surroundings – Stupini, Sanpetru, Harman, Tirlungeni – and the cause was the Agricultural Fertilizer Administration.
“According to the Code of Good Agricultural Practices, their use is allowed during this period, despite the temporary olfactory discomfort. Organic fertilizers are a recognized and recommended practice at the level of the European Union”, – notes the Environmental Protection of Brasov.
The institution makes several clarifications regarding its responsibilities:
- “The National Environmental Guard operates on the basis of GD No. 1005/2012, which defines its powers within the law; article 13, paragraph 1, letter ș: “it participates in the rapid exchange of information with competent national and international institutions and bodies, regarding the sphere of competence.”
- Decree No. 21/2002 on the management of urban and rural areas clearly defines the competence of UATs, the first responsible for the protection of the environment, who are obliged and must fulfill priority duties for the protection of the environment and human health. population. Art. 8, letters:
- a) necessary measures to protect public health with the support and supervision of specialized state bodies;
- b) appropriate measures to preserve and protect the environment;
- c) prevention of accidental pollution of the environment or water sources and watercourses due to uncontrolled storage of waste by business entities or citizens;
- Note that in accordance with the provisions of Art. 64^ GEO No. 195/2005,
- (1) In case of receiving complaints from the population regarding the presence of olfactory discomfort, the central body of state power on health protection issues answers to these complaints through its subordinate structures.
- (2) If the central health protection body, through its subordinate bodies, as a result of the investigation, reveals the presence of a cause-and-effect relationship between olfactory discomfort and the state of health of the population, it shall notify the competent environmental protection body responsible for issuing normative- legal acts in the field of environmental protection for revision and updating of relevant acts.
- Environmental protection is an institution that combines information provided by other institutions with competence in one component, for example: public health, competence of DSPJ, protection of surface and underground water quality, competence of SGA Brașov, forests, competence of forest protection, etc. . After the regulation and partial intervention of these institutions, with the completion of special legislation, the Environmental Protection intervenes, which has powers over environmental factors, and which then combines the elements of public health, discomfort due to disturbing factors from air, water, soil, basement, waste , noise, vibration, social factor.
- There are 5 air quality monitoring stations in Brasov managed by the Brasov Environmental Protection Office and the Brasov County Commissioner receives the data provided by them based on the operating rules and monitoring program drawn up in accordance with the specific applicable legislation.
- “Ecological Guard” does not have equipment to determine the level of emissions into the atmosphere, and there is no equipment for smell!
- In the last period, the commissioners in CJ Brașov work 24 hours a day, they immediately proceed to reports from the public, regardless of time (and within a limited effective number) in areas reporting odors or waste, the management of which is outside the special environmental legislation.
- Regarding the waste and the possible smell coming from the waste ramp owned by FIN ECO SA, it operates on the basis of the Integrated Environmental Permit No. SB 112/2010, revised on 01/18/2022. Cells I and II are closed in accordance with national standards, temporary closure of cell 3 will be carried out in September 2022 after obtaining an environmental permit from the Brasov Environmental Protection Agency.
- The HNM constantly monitors the operation of this ecological waste ramp, in August 2022 no inconsistencies regarding the improper operation of facilities or technological flow were recorded.”
