
Magistrates of the 2nd District Court on Friday sentenced the driver who fatally injured two girls in the Andronache district of the capital last year to 4 years and 6 months in prison with execution, reports Agerpres. The decision is not final and may be appealed.
According to the court’s decision, Marcela Leonte received 4 years for involuntary manslaughter and 1 year and 6 months for driving a vehicle on public roads while intoxicated.
Both sentences were combined and, applying the increase, resulted in 4 years and 6 months imprisonment with execution.
On the civil side, the judges decided that SC Asigurare Reasigurare City Insurance SA (a company in bankruptcy) must pay through the judicial liquidator to CITR Cluj SPRL branch more than 800,000 euros as compensation for moral and material damage to six civil parties in the case (family members two girls ).
The decision is not final and may be appealed.
Note that the case was registered in court in April 2021, but the judges found a number of violations in the indictment drawn up by prosecutors.
Then the judges gave a deadline to the prosecutors to say whether they leave the referral of the woman to the court with the elimination of the violations, or demand the return of the case.
However, the prosecutors decided to leave the lawsuit to the court, without eliminating the detected violations, and the court obliged to return the materials to the prosecutor’s office for finalization of the indictment.
He fatally injured a 6-year-old and a 20-year-old girl on the sidewalk
On February 27, 2021, 57-year-old Marcela Leonte lost control of the car she was driving on the street in the Andronache district of the capital, crashed into a pole, after which the car was thrown onto the pavement, where she was killed by a 6-year-old girl and a 20-year-old girl. Two victims were rushed to the hospital, but it was not possible to save them.
Immediately after the accident, the woman driving was attacked by the relatives of the injured girls, and she was also taken to the hospital. The angry mob also dragged the woman’s husband, who was sitting in the right seat next to the driver, out of the car and beat him.
In a statement given to police, the driver would say that she had had her license for a long time, but that she did not drive regularly and had no experience driving a car with an automatic transmission. She would have gotten behind the wheel that day because her husband had been drinking. At one point, he would mix up the car’s pedals and hit the accelerator instead of the brake, causing the car to end up on the sidewalk where he fatally injured two girls.
She stated that she did not drink alcohol, but she refused to be tested on a breathalyzer, so biological samples were taken from her. According to the results of the INML, at the time of the accident, the woman’s blood contained 1.25 g/l of pure alcohol.
