Dani Alves, accused of raping a young woman in a Barcelona nightclub in December 2022, said she “could have left at any time if she wanted”. The former Brazilian football great’s trial ended on Wednesday, with a verdict expected in 30 days.
Dani Alves denies rape allegations: “He didn’t tell me he didn’t want to have sex”
Alves, who has been in pre-trial detention for more than a year and denies the charges, is accused of raping a young woman in the VIP toilet of the Sutton Club in Barcelona on the night of December 30-31, 2022.
During his 15-minute testimony in a Barcelona court, the former defender broke down in tears, said he was not a violent person and said his “world came crashing down” when he read in the press that he had been accused of rape.
“We just had to eat, but the food took longer at Taberna del Clinic. I met my friends. It lasted until one o’clock in the morning. I ordered five bottles of wine and a bottle of Japanese whiskey. I drank two bottles of wine and a glass of whiskey.
After leaving the restaurant, we went to Nuba, where we drank a gin and tonic. When I left, I took the car out of the parking lot and my friend Bruno was driving because I was too drunk to drive.
After Nuba I went to Sutton with Bruno. I arrived around 2:30 am. I was taken to table 6. I didn’t specifically ask for table 6. I asked to be moved to table 7 with no problem. There is only one toilet behind table 6. I’m a Sutton customer and when this table is available I don’t have to walk the whole club to get to the toilet.
We started drinking and dancing with Bruno. Two girls came and danced. Then they invited three girls, the applicant and her friends. They were not at all embarrassed. They came up and started greeting us. A conversation began. I think they knew who I was. He put his hand on my back and started to touch me. We danced and talked. We were closer, he started dancing closer to me. It was a typical disco dance.
She said yes to go to the bathroom, I didn’t have to insist. I waited for a while, I thought that he would not come, that he did not want to. And when I opened the door, I almost ran into her. He sat on his knees in front of me and started giving me oral sex. I took off my pants and sat on the toilet. Fellation lasted almost the entire time. Then he sat down at my feet (…) I ejaculated outside.
He never once told me he didn’t want to or anything. I didn’t slap her, I didn’t throw her to the ground. I am not a cruel man. She didn’t tell me she didn’t want to have sex.
When I left the disco, I drank too much. My wife was sleeping (…) Then I learned from the press that I was accused of rape. The world collapsed. I was practically broke because they blocked my account in Brazil and canceled all my contracts” – Dani Alvesquoted by News.ro.
The prosecutor stated that the young woman did “as much as she could”: “If at some point the victim said “no, enough”, then it means “no, enough”. Mr. Alves would not have been able to continue if the victim had not given his consent.”
Joana Sanz, partner of the former FC Barcelona and PSG star, testified on Tuesday: “He came home very drunk, he smelled of alcohol. He hit the closet and fell on the bed. It was not worth talking to him in such a state, it was better to postpone it until the next day. I asked him on WhatsApp if he was coming for lunch and he said no. The last message was received around 23:00.
