Lawyer Nick Kyrgios argued that the tennis player wanted to defuse the situation and therefore called Uber to leave the scene. He also mentioned that Passari kept Kyrgios out of the car for a long time while he tried to get her to stop “legally”.

“Because of his annoyance, my client reacted, and so the incident happened. At that time there was also a mental health problem, although now the defendant does not face such a problem, ”said the tennis player’s lawyer Michael Kukulies-Smith.

According to him, Nick Kyrgios apologized the next day, taking responsibility for his actions.

Passari reported the incident to the police a month later, but did not file a formal complaint. The couple then got back together for a while, but eventually broke up. After the final breakup, the young woman filed a formal complaint in December 2021.

He was not condemned

After his guilty plea, Judge Beth Campbell called the whole incident “an act of stupidity and irritation” and decided not to sentence the tennis player. “This is a young man who was trying to get out of a difficult situation,” he said.

And turning to Nick Kyrgios, she said: “You performed in a boiling state of mind. I treat you the same as any young man on this court, you are just a young man who plays tennis well.”
