“Certain responses to questions about artistic professions raised in the public debate about PD 85/2022 and according to the statements of the Prime Minister” are given by the two rulings on the competence of the ministries of interior and finance, which were presented to Parliament on 30/1, said in a statement released today Ministry of Culture.
The first provision “applies to the OTA, the existing regulation concerning the supervised organizations, NPDD and NPID of the state, according to which the salaries of artists are determined by a joint ministerial decision of the co-competent ministers. The above agreement has become necessary so that there is no doubt that even in the OTA, the salaries of artists are determined in a special way, taking into account the special nature of their work, ”the announcement notes.
According to the second ruling, expressly excluded from the scope of PD 85/2022, the use of artists to provide purely artistic work to public sector bodies. With this regulation, what has been clarified by the government from the beginning is reflected in the legislation, i.e. employment with any employment relationship of artists is excluded from PD 85/2022 if it concerns the provision of a purely artistic work. In addition, he is exempt from the recruitment of educational art departments at all levels of education of the Ministry of Education and Religious Affairs, where a separate qualification list is in force and applied. The regulation also confirms that the implementation of the AP does not involve the transformation of existing positions of artists at the level of technological education into positions at the level of secondary education.
With the above settingsput an end to any doubts raised during the public debate about whether PD 85/2022 in any way affects the recruitment, employment and remuneration of artists in the state, as well as their academic issues.. In addition, their fair remuneration is provided by the state horizontally, while the relevant circular of the Ministry of the Interior must follow,” the Ministry of Culture said in a statement.
