AT parliament draft law of the Ministry of Justice on a special criminal register of crimes against minors.

According to the Ministry of Justice, the bill includes a provision on a special part of convictions for crimes under articles:

  • 299 (premeditated murder),
  • 306 (risk exposure),
  • 312 (inflicting bodily harm on a weak person),
  • 323A (trafficking),
  • 324 (abduction of minors),
  • in Chapter 19 of the Special Part of the Criminal Code of the Russian Federation [ν. 4619/2019] which deals with crimes against sexual freedom and crimes of the economic exploitation of sexual life
  • in Law 3500/2006 on domestic violence when these crimes are directed against a minor.

These rules are intended, according to the announcement, to further protect minors when the legitimate benefits of sexual freedom, personal liberty, life and physical integrity are violated. In this way, a database is created that provides additional guarantees for the protection of minors to public or private bodies whose task is the protection of minors, the care, treatment and education of minors.

In addition, these provisions are harmonized with Article 5 of the Council of Europe Convention for the Protection of Children against Sexual Exploitation and Abuse (Lanzarote Convention), which was ratified by Greece by Law 3727/2008. At the same time, the draft law incorporates into national law Directive (EU) 2019/884 on the exchange of information on third-country nationals and the European Criminal Records Information System.

In particular, the new provisions facilitate the exchange of information derived from criminal records between the competent authorities of the Member States in an efficient, fast and accurate manner. In addition, the identification of convicted third-country nationals and stateless persons is requested to enable identification by Member States with information on their previous convictions. In addition, the free movement of persons within the EU is served. and taking appropriate measures to prevent and combat crime, in particular organized crime and terrorism.
