The Court of Appeal of Tirgu Mures sentenced the former mayor Mircea Rus to two years in prison for the crime of complicity in the embezzlement, which continued, for 26 important documents, in connection with one of the cashiers of the Bandu City Council at the time, Garb Peter, and another two years in prison, for the same crime, in connection with the second cashier Bodor Zoltan, also for 26 physical documents.
According to the court portal, since Mircea Rus was convicted of abuse of office, for which he was sentenced to one year and 4 months of imprisonment with a suspended sentence, the Tirgu Mures Court of Appeal combined the two sentences: 2 years of imprisonment with a penalty of one year and 4 months of imprisonment, applied by Criminal Judgment No. 10. 179/3 July 2015 of the Court of Mures, amended and finalized by Criminal Decision No. 348/A/June 20, 2018 of the Court of Appeal of Tirgu Mures for committing the crime of abuse of office against public interests.
In this regard, the court decided that “applies to the defendant the most severe punishment in the form of 2 years of imprisonment, to which he adds an increase of one year, one month and 10 days of imprisonment (which is a third of 3 years and 4 months in imprisonment) and imposes on the defendant Mirchi Rus the appropriate basic punishment of 3 years, one month and 10 days of imprisonment with execution in custody”.
The decision issued by the Court of Appeal of Tirgu Mures in case 4881/320/2020 is final and obliges the former mayor and two former cashiers to return the amounts to UAT Band with the payment of fines provided for in the Fiscal Procedure Code.

It jointly and severally obliges the defendants Garba Petra and Rus Mircha to pay the civil participant UAT Comuna Band the amount of 281,564 lei (140,782 lei each of the defendants), to which are added fines for late payment, according to the Fiscal-Procedural Code.
- It forces the defendant Bodor Zoltan to pay the civil member of the UAT Comuna Band the sum of 53,400 lei, plus fines for late payment, in accordance with the Fiscal Procedure Code.
- It obliges the defendants Bodor Zoltan and Rus Mircha to jointly and severally pay the civil participant UAT Comuna Band the sum of 105,963 lei (52,981.5 lei each of the defendants), to which are added fines for late payment, in accordance with the Fiscal and Procedural Code”, About this is stated in the decision of the Court of Appeal of Tirgu Mures.
