Which telecom operators received the biggest fines in 2022

The communications regulator announced on Wednesday that last year it imposed fines worth more than 2.8 million lei after more than 3,500 inspections, and HotNews.ro asked which operators received the biggest fines:

  • “In the segment of telephony, the largest fine of 60,000 lei was applied to the company Orange Romania Communications SA, and in the market of Internet access services, the largest fine of 40,000 lei was also applied. of Orange Romania Communications SA
  • In the television and sound broadcasting (RTV) market, the largest fine of 10,000 lei was applied to the companies AG RADIO HOLDING SRL, BALADA STUDIO MUSIC SRL and CANET RADIO SRL.
  • In the market of CATV networks and services, the largest fine of 40,000 lei was applied to the companies Orange Romania Communications SA and Vodafone Romania SA
  • In the market of radio equipment and electromagnetic compatibility, the largest fine of 20,000 lei was applied to the company Intertoy Zone SRL.

More than 3,450 inspections and fines for more than 2.8 million lei in 2022

During the day, the authorities published the results of inspections conducted last year.

  • “After inspections carried out last year, fines in the amount of more than 2.8 million lei were imposed for the detected violations. Although the majority of fines have been applied to the electronic communications market, a slight increase in sanctions applied to the radio equipment and electromagnetic compatibility market can be observed,” said Christine Popa, Director of ANCOM’s Executive Directorate for Monitoring and Control.

As a result of 3,451 inspections, ANCOM sent 195 notices and applied 636 warnings and 347 fines for offenses totaling 2,809,400 lei. The amount is income to the state budget.

Market of electronic communications

In 2022, ANCOM conducted 1,988 control measures on the electronic communications market, offenders received 195 notices, 287 warnings and 122 fines for offenses in the amount of 2,004,200 lei.

72 fines for offenses in the total amount of 1,336,500 lei were applied by the Authority to telephone service providers for breach of obligations regarding the conclusion of contracts with end users, implementation of the transfer process or breach of other obligations.

5 fines for offenses totaling 195,000 lei were applied by ANCOM to Internet access service providers, the largest of which, 40,000 lei, was applied for supply without a valid contract concluded with subscribers.

6 infringement fines totaling 40,000 lei were also applied to television and audio broadcasting (RTV) service providers, mainly for non-compliance with technical data, parameters or conditions contained in technical permits.

Providers of CATV networks were sanctioned with 32 fines for violations in the total amount of 400,500 lei for non-compliance with the conditions set out in the general authorization regime, and radio operators were sanctioned with 7 fines in the amount of 32,200 lei for using certain frequencies without a license or non-compliance with technical and operational parameters of radio stations.

Market of radio equipment and electromagnetic compatibility

In the market of radio equipment and electromagnetic compatibility, ANCOM conducted 980 inspections, as a result of which 288 warnings and 178 fines were issued for offenses for a total amount of 597,000 lei. The largest fine was 20,000 lei for improper CE marking.

In terms of electromagnetic compatibility, the largest fine of 10,000 lei sanctioned the introduction of devices on the market without the manufacturer’s address.

Market of postal services

In the postal services market, ANCOM carried out a number of 483 control measures in 2022, as a result of which 61 warnings and 47 fines were applied for offenses amounting to 208,200 lei, the most frequent finding being non-compliance with the obligations imposed through the general permit regime.

Out of the total number of inspections, 6 related to the inspection of the Romanian National Postal Company (CNPR) as a universal service provider, resulting in 4 fines totaling 40,000 lei.

The main violations consisted in the unauthorized provision of postal services, non-compliance with the methods of delivery of postal items to recipients, non-compliance with the content of confirmations of receipt or postal messages, and non-registration/marking of postal items.
