
The end of 2022 brings control decisions in two tax disputes in the field of insurance, thus successfully ending for taxpayers before the High Court of Cassation and Justice (ÎCCJ) the fiscal saga unfolding against the ANAF regarding the imposition of related VAT Services provided by specialized partners from other EU member states, as well as social contributions related to income paid to insurance agents under agency contracts. Legal assistance was provided throughout the tax dispute by the tax dispute team of D&B David and Baias SCA in cooperation with tax consultants PwC Romania.
About 7 years ago, a series of tax audits, which had been conducted at the level of insurance companies for more than 3 years, ended. The audits concerned budget obligations for the period 2007-2011, the negative property consequences of which are significant. Additional VAT payment related to Green Card claims management services provided by some correspondent companies of these insurers from other EU member states, as well as social contributions related to income received by insurance agencies under special agency contracts , concluded with insurance companies.
