
Carer’s leave is leave given to employees to provide care or personal support to a relative or person living in the same household as the employee who requires care or support due to a serious medical problem.
This was introduced this year in the Code of Labor Laws by Law 283/2022. More precisely, it is about 5 working days.
The Ministry of Labor has prepared an implementation order that is currently under discussion.
How to apply for care leave
The employer is obliged to grant the employee a leave to take care of him upon his written application.
Within no more than 30 working days from the moment of submission of the application, the employee is obliged to submit to the employer documents confirming that the person to whom he provided care or support is a relative or a person living in the same household. like his, for example, and about the presence of a serious medical problem that led to the request for leave to care for the employee.
What documents are required for care leave
Documents confirming that the person to whom he provided care or support is a relative, depending on the circumstances:
- an identity document
- Birth Certificate
- marriage certificate.
In addition, documents confirming that the person to whom he provided care or support lives in the same household as the employee, depending on the circumstances:
- a document certifying the identity of the person in need of care, which indicates the same place of residence or residence as the employee,
- action by which a person was launched into space,
- HOA certificate
- self-declaration by the employee that the person to whom the employee provided care or support lives in the same household with him at least during the period of care leave
The medical document proving the presence of a serious medical problem will be a hospital discharge slip or, as the case may be, a medical certificate issued by the attending physician or family doctor of the person with the serious medical problem.
List of medical issues for granting care leave
The Ministry of Labor has also prepared a list of medical problems in connection with which an employee can request leave for care, from ophthalmological to psychiatric or dermatological diseases.
