
USR Senators Anka Dragu, Claudio Mureşan and Narcis Mircescu have submitted a legislative initiative that proposes to abolish “abusive sanctions” by ANAF for taxpayers who failed to submit their tax returns on time due to technical problems at the Ministry of Finance.
Currently, taxpayers who do not submit tax returns on time are punished with fines of thousands of lei, even if the delay was caused by technical problems of the Ministry of Finance. The UDR initiative cancels these sanctions on the condition that citizens register their declarations within no more than 30 calendar days after the statutory submission deadline, the press release states.
“This is unfair treatment by ANAF to those it is supposed to support! The situation has worsened in recent years, and the facility’s modernization program has been abandoned since 2018. If the state does not give the opportunity to complete and submit the declarations in civilized conditions, it cannot have the right to impose fines, to pursue companies that do not fulfill them due to the fault of the state. ANAF,” explains USR Senator Anka Dragu, according to a USR press release.
According to USR Senator Narcis Mircescu, entrepreneurs must be supported, and their relations with the state must be correct.
“This initiative supports taxpayers who cannot be prosecuted by ANAF for mistakes that are not their fault. The probability of erroneous reporting due to the short preparation time is higher compared to the situation when the report is available on time, can be checked and understood”, says Narcis Mircescu.
USR Senator Claudio Mureșan states that the proposed project aims to correct the “abnormality and injustice” that occurs when a taxpayer is fined by the tax authority for late filing of tax returns due to technical or other problems not related to the taxpayer.
“Recently, the ANAF servers where e-declarations must be submitted have been down for a long time or have been malfunctioning, especially in the periods before the submission deadline. Penalties for violations, applied for late fulfillment of declaration obligations, range from 1,000 lei to several tens of thousands of lei,” the press release states.
