  • “Art. 15. – (1) Starting from September 1, 2022, during the period of application of the provisions of this emergency order, producers of electric energy, subjects of aggregated production of electric energy, traders, suppliers who carry out trading activities, and aggregators trading volumes of electric energy and/ or natural gas on the wholesale market shall pay a joint contribution established in accordance with the provisions of the methods specified in Appendix No. 6 and Appendix 6.1.” it is shown in the GEO project.

The price ceiling has been extended until August 31, 2023

According to the order, the price limit has been extended until August 31, 2023:

On electricity:

“For consumption in the period from September 1, 2022 to August 31, 2023, the final price set by electricity suppliers is:

  • and) a maximum of 0.68 lei/kWhwith VAT, for household consumers, the average monthly consumption at the point of consumption in 2021 is from 0 to 100 kWh inclusive;
  • b) a maximum of 0.80 lei/kWh, including VAT, in the case of household consumers whose average monthly consumption at the point of consumption in 2021 was between 100.01 and 300 kWh, for a maximum monthly consumption of 255 kWh. The bill for electricity consumption exceeding 255 kWh is billed in accordance with the provisions of Article 5 paragraph (1).
  • c) a maximum of 1 lei/kWhincluding VAT, for 85% of the average monthly consumption at the point of consumption in 2021, in the case of small and medium-sized enterprises, as defined by Law No. 346/2004 on the promotion of the creation and development of small and medium-sized enterprises, as amended, hereinafter referred to as SMEs, economic entities in the food industry, based on the declaration of personal responsibility of the legal representative.
    The bill for the difference in monthly electricity consumption is billed in accordance with the provisions of Article 5, paragraph (1);
  • d) a maximum of 1 lei/kWh, with VAT, for full consumption by public and private hospitals designated under Health Care Reform Act No. 95/2006, reissued, with subsequent amendments and additions, public and private educational institutions designated pursuant to the National Education Act No. 1/2011 with the following amendments and additions, as well as orphanages, state and private providers of social services, which are provided in the Nomenclature of social services, approved by Government Resolution No. 867/2015 on approval of the Nomenclature of social services, as well as framework provisions on the organization and operation of social services with the following changes and additions,
  • e) a maximum of 1 lei/kWh, including VAT, for 85% of the average monthly consumption achieved at the place of consumption in 2021, for public institutions, except those provided for in point d). The difference in monthly electricity consumption is billed in accordance with the provisions of Article 5, paragraph (1);”
  • f) for the beneficiaries referred to in letter c) and e) who do not have a history of consumption in 2021, the percentage of 85% is applied to the monthly consumption.

For natural gas:

(2) Deviation from the provisions of Art. 180 paragraphs (1) from Law No. 123/2012, as subsequently amended and supplemented, for consumption in the period from April 1, 2022 to August 31, 2023, the final price set by natural gas suppliers is:

  • and) a maximum of 0.31 lei/kWhwith VAT, in the case of internal customers;
  • b) a maximum of 0.37 lei/kWhwith VAT, for non-household consumers whose annual consumption of natural gas in 2021 at the place of consumption is no more than 50,000 MWh, as well as for heat energy producers.
