It is not trivial to choose a path risks of accidents present always, at all times. That is why the use of alcohol is strictly regulated, and drugs are strictly prohibited. Thus, even the smallest trace tetrahydrocannabinol (THC) found in blood or saliva can lead to penalties for driving after taking drugs. However, this position is not at all unanimous. Indeed, the Union of Professionals in the Cannabis Wellbeing and Relaxation Industry (UPCBD) strongly opposes this approach. For weeks, she has called for a review of the legal thresholds for THC allowed behind the wheel and launched a petition on the National Assembly’s website about it. The authors regret that “since the decisions were made in the summer of 2023, consumers of CBD products have been systematically harassed and their driving licenses suspended.” And that’s even “if police tests demonstrate that THC levels in the plaintiff’s saliva or blood are infinitesimal.”

Towards greater tolerance?
According to the UPCBD, “France cannot ban hemp products so-called “light” or “CBD” in France, unless evidence of a risk to public health is provided. Evidence that otherwise does not exist.” Indeed, the petitioners explain that this difference in behavior compared to cannabis users “is not based on any scientific evidence. We are therefore asking for a limit for tetrahydrocannabinol to be set in the Road Traffic Rules, just like the alcohol level, and for this limit to be based on sound scientific evidence. They also note that THC can be detected for several weeks, even if the effects are gone. However, with only 1,071 signatures collected to date, the road to the 100,000 needed to consider the petition remains a long way to go. By the way, law enforcement agencies currently do not allow the consumption of cannabis while driving, which can be very dangerous, just like alcohol.
