Under a law announced Monday by President Klaus Iohannis, retailers are prohibited from selling energy drinks to minors. The regulation provides for fines of up to 30,000 lei for shops that violate these provisions, depending on the gravity of the act.
The regulatory act is aimed at introducing changes and additions to the Law No. 61/1991 on the sanctioning of acts of violation of norms of social coexistence, public order and peace, writes Agerpres.
According to the law, energy drinks contain various combinations of carbohydrates, vitamins, minerals with two or more substances, such as caffeine, taurine, carnitine, guarana, glucuronolactone and other compounds that have a stimulating effect on the central nervous system.
According to the motivation, the regulatory act regulates the ban on the sale of energy drinks that contain various combinations of carbohydrates, vitamins, minerals, with two or more substances, such as caffeine, taurine, carnitine, guarana, glucuronolactone and other compounds with a stimulating effect on the central nervous system in the premises of an educational institution, a health care institution or designated for the special protection of certain categories of low-income citizens.
The amendment adopted by the parliament provides that it is a misdemeanor to commit any of the following actions, if they are not committed in conditions that are considered crimes under criminal law: gratuitous sale or offer, including through vending machines for energy drinks to minors by units authorized to sell them.
Business entities that violate these provisions will be fined up to 30,000 lei depending on the severity of the crime. In case of repetition of violations stipulated by the project, a measure in the form of suspension of the activity of public institutions for a period of 10 to 30 days is also issued.
On February 20, the Chamber of Deputies passed a bill that prohibits retailers from selling energy drinks to minors. 238 voted “for”, “against” – one, 12 abstained.
