
ANAF and Customs had to issue an order establishing risk criteria for entry e-Seal applicationintroduced by the Law that increased taxes and introduced new ones (L296/2023).
Although they had a deadline of 60 days, they exceeded it (the deadline would be December 26, 2023), and nothing came out of the public discussion on this topic. So two establishments were late.
According to the above law, the national RO e-Seal system is a system based on the use of electronic devices and a computer program that allows the competent authorities to identify potential points of diversion of road transport of goods, regardless of whether they are in transit or have a point designation of the final business entity from the national territory.
Dan Manolescu, president of the Chamber of Tax Consultants (CCF), said last year in an interview with HotNews.ro that authorities want to install devices on vehicles to ensure the tracking of certain goods.
“It’s really about purchasing, most likely, mobile GPS devices that will be installed on vehicles, with a tracking application, maybe Google Maps or something like that, a map application that will actually show that the appropriate route is being followed. or to know at every moment where this vehicle with these goods is,” explained Dan Manolescu.
The authorities will only use the system in the case of those firms which, according to the risk analysis, are considered to be subject to supervision in this way.
According to the Law, the application of smart seals and monitoring of road transport of goods on the national territory are carried out by the National Agency for Fiscal Administration and the Customs Administration of Romania based on risk analysis.
In the case of using smart seals on vehicles, the driver is obliged to ensure their integrity. The driver’s failure to fulfill this duty is a violation, unless it was committed under conditions that are considered a crime according to the criminal law, and is punishable by a fine of 20,000 to 50,000 lei.
