Prime Minister Marcel Ciolacu said on air on Thursday that Romania is not ready for the ECtHR’s decision on the legal status of same-sex couples.
“At the moment, Romanian society is not ready for a solution. Not the first (ECtHR decision – no), and not the last conviction. Romania was also condemned for the treatment in prisons. This is not one of my priorities and, again, I don’t think Romania is ready now. I am not a stupid person, he is part of the world, I have no reservations, I have friends who are in a relationship with another man, I have no problems, I am now speaking from the point of view of the Prime Minister,” replied Marcel Colaku, according to Agerpres .
When asked, in the context of whether Romania “will violate this decision of the ECtHR”, the prime minister answered: “This is not the first and it will not be the last, but I believe that the Romanian society is not yet ready for this.”
Foreign Minister Luminica Odobescu asked the government to present the executive’s point of view by November 28, as Romania has until March 25 to present to the Committee of Ministers the measures taken or proposals considered following the ECtHR’s ruling, which requires legal status for same-sex couples.
The ECtHR obliges Romania to protect same-sex families
The Romanian state is obliged to adopt legislation on the recognition of same-sex couples. A panel of judges of the ECtHR’s Grand Chamber rejected an appeal filed by the Bucharest government against a historic ruling in May by the European Court of Human Rights, according to which the Romanian state is obliged to enact legislation recognizing same-sex couples.

However, the Grand Chamber of the ECtHR rejected Romania’s request for a retrial, according to the ECtHR website.
“In essence, the decision has entered into legal force and is subject to execution. According to ECHR standards, authorities must provide some form of legal protection to gay couples. These standards do not oblige to recognize marriage between these couples, but at least a civil partnership. This is the minimum,” the expert explained to HotNews.ro.

On May 23, the European Court of Human Rights (ECtHR) accepted a complaint filed by the ACCEPT Association and several individuals against the Romanian state, alleging a violation of Article 8 of the Court’s Convention, which provides for the “right to respect for private and family life.”
