On Monday, a panel of five judges of the Supreme Court decided to release the former mayor of Sector 1 of the capital, Daniel Tudorache, on bail, overturning a favorable decision for the former mayor, made almost 2 weeks ago by the magistrates who are trying the “Diamond File”.

On November 1, the three judges who are trying Daniel Tudorache for complicity in influence peddling and money laundering ordered the cancellation of the judicial review measure against the former mayor and his ex-wife, Adina Constanzi Tudorache, reports Agerpres.

DNA appealed the decision, winning the case before a five-judge panel: “Admits the appeal brought by the State Department – ​​National Anti-Corruption Bureau from the opinion dated November 1, 2023, issued by the ICCJ – Criminal Section, in case no. 452/01/2023. Partially cancel the disputed conclusion, and decide: to leave in force the preventive measure of judicial supervision in the form of taking bail for the accused Tudorache Daniel and Tudorache Konstanza Adina. At the beginning of March 2022, Daniel Tudorache was sent to court by the prosecutors of the National Anticorruption Office for complicity in the abuse of influence and money laundering, being placed under judicial control on a bail of 1,000,000 euros.

In the same file, the mayor’s ex-wife is on trial for involvement in money laundering.

Meanwhile, the alleged broker of the bribe for the former mayor, Ion Nice, was tried separately and ultimately sentenced to 9 years and 2 months in prison for influence peddling.

It is about the “Diamond File”, so called because of the hundreds of jewels and precious stones worth more than 9 million lei found in the house of Daniel Tudorash.

Allegations in the Diamond File: influence peddling and money laundering

According to DNA, between September 2016 and May 2017, Ion Nice, a close associate of Daniel Tudorache, then the mayor of Sector 1, allegedly demanded from the businessman a commission of 10% of the value of the contract for the provision of services, under which his company cooperated with an institution subordinate to the Sector 1 City Hall, and in exchange for the money, Niţă undertook to intervene, both directly and through Tudorache, with the responsible officials, so that the contract would be executed under the proper conditions – timely payment of bills and renewal of tariffs.

“In exchange for the influence peddling, the person in the mayor’s entourage would receive a total of 105,000 lei in cash, as well as an amount of 8,640 lei disguised as the payment of fictitious tax invoices issued by a company owned by the influence peddler. “, the investigators state.

Ion Nita would be supported by Daniel Tudorach. On the occasion of two meetings on September 19, 2016 and February 7, 2017, which took place in the office of the City Hall, Sector 1, he would strengthen the entrepreneur’s conviction that the applicant for the mandate is his representative and that he should maintain contact. with him for the quality performance of the contract. In this way, Daniel Tudorash would confirm the true nature of the influence, DNA shows.

In addition, according to prosecutors, the case file shows that Daniel Tudorache was the main beneficiary of the sums received by Ion Nice.

In a separate context, according to prosecutors, between April and June 2018, Ion Nice demanded from the same businessman a commission of 10% of the value of a contract for the provision of services concluded on April 27, 2018 with an institution located in the subordinate City Hall of Sector 1.

Instead, Nice undertook to influence the responsible officials, both directly and through the mayor, to ensure the win and the smooth implementation of the contract. On June 12, 2018, based on the request, Ion Niza should have received in cash the total amount of 5,000 lei, disguised as the payment of fictitious tax invoices issued by the company.

In Tudorache’s residence, prosecutors found 258 items (jewelry and precious stones) with a total value of 9,784,295 lei and worth 11,210 euros and 4,235 dollars.
