Constanța City Hall is obliged to pay 20,000 lei compensation to the family of a child who was bitten 14 times by a street dog while he was in the alley near the house, Ziua de Constanța reports. The decision is final.

The judges of the Court of Appeal of Constanta rejected the appeal filed by the municipality against the unfavorable decisions of the court and the tribunal.

The court ruled that “the municipality of Konstanz, through the mayor, is responsible for not taking adequate measures to catch stray dogs.”

Now the City Hall of Constanța must pay 20,000 lei in compensation to the family of the child who was attacked by the dog.

The child received 14 bites after the attack in an alley near the block where the child lives.

In the first instance, the judges of the Konstanz court established moral damages of 7,000 lei for the bitten child, the amount to be paid by the embalming company, according to SC Green Life Recycling SRL.

But in the appeal, the Court decided that the responsibility lies with the City Hall of Constanta, since “the illegal act consisted in not taking all the necessary measures to catch stray dogs.”

Regarding the amount of non-pecuniary damage, the judges said that “due to the intensity of the physical suffering and moral damage suffered by the appellant, the Tribunal considers that it is necessary to increase the amount of non-pecuniary damage to 20,000 lei. “.
