The Communications Regulatory Authority (ANCOM) is proposing to change the procedure for requesting approval and the conditions under which operators can share a radio frequency band.

Thus, joint use of the radio frequency spectrum is allowed only between operators who have rights to use radio frequencies in certain frequency bands specified in Decision No. 10. 353/2015 and only if there is no radio frequency spectrum in the relevant bands at the time of the request, provided that this the measure does not restrict, prevent or distort competition.
Operators must meet all of their individual coverage or development obligations, if applicable, included in the licenses they hold, even if they share radio spectrum.
The draft decision also provides for the possibility of leasing all or part of the rights to use radio frequencies in the case of the radio frequency bands also specified in the mentioned decision.
The lease of the rights to use radio frequencies requires the prior consent of ANCOM, which will analyze whether this action allows to maintain sustainable competition between operators and whether, thanks to the investment in technology it brings, it really contributes to the increase of the communication offered to users.
Other proposed changes are aimed at simplifying the authorization procedure for base stations of mobile and mobile/fixed electronic communication networks for public use, which are the subject of licenses for the use of frequencies granted through the selection procedure in frequency bands.
