Many people sell their outdated or unloved items by turning to platforms like OLX. Considering the fact that ANAF has started control in this area, many people wonder: if I sold a bicycle or a phone (if I bought a new one), do I have to pay something to the state? Is it necessary to submit a single declaration?

The short answer to both questions is: No!

According to tax fraud officials, the reason you don’t have to pay anything is because it’s not a commercial activity.

This was confirmed to us by tax consultant Cornel Grama: “Of course, this is not a commercial activity, as it is an asset from a personal inheritance. The problem arises when the sale is continuous.”

More precisely, according to the Tax Code (Article 269, paragraph 2) “business activity is the use of tangible or intangible assets for the purpose of obtaining income of a continuous nature.”

Therefore, if you sold personal items through various platforms, you should not declare income to ANAF and should not pay anything to the state.

We remind you that Antifraud ANAF is preparing for inspections of individuals who conduct commercial activities on the Internet and have earned cash.

“We have identified 22,000 individuals from one courier who received refunds to a collection account of approximately 1.8 billion lei and did not submit any tax returns for this money,” said Teodor Alexandru Georgescu, Director General of Antifraud at the institution.

  • “We will not consider people who sold a children’s bicycle on OLX. We focus on people engaged in commercial activities,” he said.
