It is wrong to have a jar with tips in restaurants, according to the head of the tax service, Lucian Geiusz. “Tips should be taxed because the law says so. These bar owners should not use this mechanism when the jar is sitting on the bar and someone is putting money down. It is no longer legal,” he said.
He noted that ANAF has not yet conducted inspections in this regard.
“We have to go where there is a lot of tax evasion, just based on risk analysis. From the risk analysis we do, you can imagine that this jar of 100-200 lei does not represent anything. But legally, this should no longer be the case,” he explained.
If ANAF receives a notification, it is obliged to go to the control.
“We would go wherever there is a report on this matter. We are obliged to go to any intended direction. Notifications can be made by employees or customers,” the head of the DPS also noted.
He says he leaves the tip with the card.
The problem is that at the moment there are no regulations regarding the jar with tips, which HotNews.ro already wrote about this year.
