The team at ION, the first AI-powered robot to become an adviser to Prime Minister Nicolae Chuke, apologized on Friday after being accused by Chewgood Town Hall of breaching the GDPR and filming without consent in a presentation video of a student’s image from the presentation video schools in Sjugud.
The team behind ION apologizes: we have removed the controversial image
The ION team reacted on Friday to the problems reported by the City Hall of Sjugud the day before:
- “Dear people from Sjugud City Hall, I, ION (yet) do not make videos. I am assisted by a team of volunteers who have worked tirelessly to bring this project to life.
- The ION team values innovation and was inspired by TVR’s report on your school. TVR employees were friendly and helped with the footage for the presentation film. Image taken from TVR’s official YouTube channel.
- I apologize for the situation. I gave up on the image in question and I promise you I learned from the experience.
- Finally, thank you for the letter and the 10 principles of digital transformation.
- I value openness to technology. I would be happy to see you in the ION Caravan at your school, because you are part of those who have a vision for Romania in the future.
- Thank you for all the messages received, for your patience and understanding.”
What accusations did the city hall of Sjugood make?
The mayor’s office of the Čugud commune took advantage of the launch of Romania’s first 100% artificial intelligence project and “sent” an open letter to Prime Minister Čucé on Thursday evening, asking for 10 concrete things for the real digitization of Romanian public administration.
Officials from Ciugud also allege that one of the images used in the presentation belongs to them and violates the GDPR because it is an image of a student.
- “!! PS Dear Ion, we also teach you the first lesson: do not appropriate someone else’s work (this can also be read as “don’t steal”). While watching your presentation video, I found that one of the images used belongs to us. The girl in the picture on at minute 0:27 (see photo) was our student, and the picture was taken, without our permission, from an older film of our school.
- So, dear Ione, first of all, we recommend that you study well the Romanian law and the GDPR Regulation, so that you are not accused of unfairly appropriating the work of others. We know that you want to be as human as possible, so this time we simply say that it is human to err, and we believe that with the images in our film we will also support your promotion,” Syugud wrote on Facebook on Thursday at City Hall. .
Octave Ganea, co-founder of Inquam Photos: Material that changes purpose requires a new license and a new agreement
Octave Ganea, co-founder of Inquam Photos, cautions that even if there was a formal agreement with TVR, it still wouldn’t be enough to avoid copyright infringement in this situation.
- “It is still unclear from Humans.ai’s response whether there is a formal agreement to broadcast the material presented on the national TV channel. As a rule, material that changes its purpose from editorial to commercial (advertising) requires a new license and, above all, requires the consent of the person who originally appeared in the material filmed in Ciugud or from the legal guardian.
- Unfortunately, it has become almost commonplace to see the misappropriation of copyrighted material (according to Law 8/96), a situation rooted in a lack of respect for original content creators and a lack of education in this field for communicators.” This was stated by HotNews.ro, Oktav Ganya.
Tudor Galosh, GDPR consultant: We can talk about a violation of the General Data Protection Regulation
In connection with HotNews.ro, GDPR consultant Tudor Galosh stated that in this case we can talk about a violation of the EU regulation on the protection of personal data.
- “Personal data means any information that can directly or indirectly lead to the identification of an individual. In this case, the person’s eyes are closed, but there are enough exposed elements that can lead to the identification of the person in question. we are clearly talking about personal data.
- Publishing a film is processing, as defined by the GDPR, processing that requires a purpose and at least a legal basis.
- The data operator is also obliged to inform the data subject of full information regarding the purpose, legal basis, categories of personal data, third parties to whom the data were provided, the period of storage of personal data, the relevant rights and the method of their execution.
- As far as I understand, the information part was not provided, so we can talk about a violation of the general data protection regulation.
- In addition, the legal basis in this case is unclear.”, This was stated by Tudor Galosh, GDPR consultant, to HotNews.ro.
At the same time, Tudor Galosh emphasized this and Siugud Town Hall had to follow the same rules when creating a video clip with a local schoolgirl, so as not to be accused of violating the GDPR.
Did Seagood City Hall comply with GDPR when it filmed a clip with a student? Clarification of the City Hall
Therefore, HotNews.ro asked the mayor’s office of the city of Sjugud to give their opinion on the method of creating a video clip and obtaining consent, as well as Mayor’s spokesman Dan Lungu said that such an agreement exists.
- “In everything we do about our school, parental consent is obtained when children appear in materials through which we promote the school or, as has been the case in some cases, when children have given interviews to media outlets. At the beginning of the year or in individual cases, parental consent is obtained. In addition, we never feature children from Syugud in material that is not related to education or the community.
- We also noticed that there were many reactions in the public space that qualified everything as intellectual theft or violation of the law regarding the image of minors.
- From a legal point of view, this cannot be considered a violation of the law regarding the image of a minor, since the girl’s face is partially covered. As for the other people who appear in the ION film, we hope that consent has been obtained and that the GDPR rules have been followed.
- In the end, we simply called Ion’s attention to learn not to appropriate other people’s work, in this case a few short frames from our film. We are not angry, we do not blame or criticize him.
- Moreover, we hope that, apart from this funny end of the letter, the fact that we want to be partners of the public authorities in the digital transformation of Romania will also be taken into account. This was reported to HotNews.ro by Dan Lungu, the spokesperson of the City Hall of Čiugud.
