As recalled by today’s decision, the 2017 construction permit and its revision in 2019 were declared illegal in 2019 (Plenary Decision 2102) because the permit had not previously been issued by the Ministry of Culture on the recommendation of the CAS. The Ministry of Culture reacted to this decision in July 2020 by rejecting a study of the hotel in terms of maximum height (33 meters compared to 24 meters in area) at the suggestion of the CAS, as well as the Ministry of the Environment. , which in March 2022 established a new decree of the president of the region, which also followed the old ones in force in the region of maximum height.

On the contrary, the SC points out, the municipality of Athens did not revoke the permit for the construction of the building, did not designate the last two floors and the roof of the hotel as unauthorized and subject to demolition, and did not organize their demolition. Instead, he only withdrew the 2019 revision, which for the Supreme Court to annul “is not compliance.”

The Compliance Board has given the Municipality of Athens a three-month time limit to take all necessary action, indicating that it will review the matter on February 14, 2023.
