The problem is that the General Inspectorate of Immigration works with the same number of people, and the bureaucracy is just as large. Basically, this year’s blocking will also be in 2023.

“At the moment, if foreign workers can apply for a residence permit when they arrive in the country, it currently takes about six months to actually receive that document,” says Elena Panciru, co-founder of the Association of Employers of Labor Importers from Romania. .

All this time, she says, in the case of emergency medical care, when hospitalization lasts more than three days, or even when they are legalized by the authorities, these people are nobody’s business.

“We had a foreign worker who was injured in a traffic accident, and who, without a CNP and health insurance, was in real danger. Fortunately, this case was successfully settled by the employer, who offered to cover the colossal costs of the sick leave. However, consider that these are abnormal situations in which the safety of foreign citizens in our country comes first,” she said.

What solutions do entrepreneurs offer?

The first solution presented to the authorities since the beginning of this year is the expansion of the organizational chart both at the level of the General Inspectorate for Immigration and at the level of the Ministry of Foreign Affairs.

“There is not enough staff to process our documents. We continue to work with the same people with whom we cooperated before the quota of foreign workers was increased to 100,000. In addition, there is a need to streamline the cumbersome document flow both in the IGI and in the embassies. Documents uploaded to the Institutional Portal should also be submitted in physical format and this should stop. It’s enough to do everything digitally,” Olena Pantsyru added.

ANAF tried to meet the employment agencies and recruitment of foreign personnel in Romania with a number of measures, such as the possibility of obtaining NIF (fiscal identification numbers) instead of CNP (to be included in application 112).

According to the press release, the procedures are complex and are often avoided by recruitment agencies and Romanian employers.

In this case, after receiving the CNP, a correction application is made to replace the NIF with the CNP, which again turns into two procedures with the same objective. In addition, the personal numerical code must be sent to ANAF immediately after receiving it.

In addition, NIFs apply to workers who come to Romania for a maximum of 6 months, given that the vast majority of foreign workers come on contracts of at least 2 years.

In addition, the Labor Importers’ Trust also offers system identification by the General Immigration Office, whereby when a foreign national’s documents are uploaded to the portal, a CNP can be automatically generated for him.

How difficult is it to bring a person to Romania and how to act in the General Inspectorate of Immigration

HotNews.ro recently spoke with Romulus Badea, vice-president of the Association of Labor Importers and partner of Soter&Partners, to understand how to bring a person to Romania and what problems arise.

According to him, to get a work permit, you need to make a package of documents. You also conduct research on the local labor market. This means you go to AJOFM and ask if there are any unemployed people available.

After that, you place an ad in a newspaper with a large circulation. Then you make a report in which you say that you did it, and no one showed up. At best, it takes about two weeks.

Then you create the rest of the files and submit them online to the Immigration Office. At some point they schedule you for physical submission. It can take up to two and a half months between the time you file online and the time you file physically. During this time, documents for online submission expire.

So you go and physically deposit. You cannot submit without prior registration. They do not accept your documents freely.

There were situations when the website was checked and notifications appeared that files should be sent, but the letters did not arrive. why Their email would be blocked and not sent.

If you miss your appointment, you will have to reapply online and wait another 2 1/2 months.

Many times, companies are notified overnight that they have to appear the next day, at which time a certificate from the tax office is required again, which expires in 30 days.

“There are emails sent at 11pm only to appear the next morning. If you have an expired document, you get rejected and you have to start over,” says Badea.

After the arrival of workers, the visa is valid for 90 days. You have to do the occupational medicine etc., schedule the tests and finally you do the work file. Once you do this, you apply online to make an appointment. If you get an appointment for a physical after your visa has expired: bad luck.

That is, you came, worked for 2 months and you are fired.

Some foreign workers do not have insurance, even if they are paid premiums

Another situation, says Badya, is when an employee arrives, has a visa, submits documents for registration, but he works.

He waits for admission for 2 months, and the residence permit is issued for a month. The CNP is responsible for the residence permit. Until the CNP is obtained, health insurance cannot be obtained, even though the employer pays. It cannot be included in the 112 declaration, which is submitted to ANAF every month.

After receiving the CNP, the employer amends the D112. If there are 20 people in it, it is normal. If it has 2000, that’s a problem.

If an employee has an accident, even though the money has been paid, he cannot get hospital insurance because he does not have a CNP and is not on the list of insured persons.
