On July 27, 2022, the ex-general director of the Public Gas Company (DEPA), Theodoros Kitsakos, sent an out-of-court invitation-statement to K. In it, he refers to the irrevocable judgment of acquittal no. 536/2022 of the same will of the Athens Council of Contraventions in relation to the case of the debts of the company ELFE SA in the period 2015-2017, for which he was prosecuted on charges of infidelity.

“Regarding this accusation against me,” says Mr. Kitsakos in his out-of-court statement of summons, “judgment no. With this testament, the Judicial Council, having accepted the proposal of the prosecutor, unanimously decided not to charge me with the criminal act of adultery, recognizing that this offense was not even objectively justified. In order to substantiate its decision, the Judicial Council, with general reference, accepted the proposal of the prosecutor that during my tenure as managing director of DEPA SA there was no significant increase in the debt of ELFE SA, that they carried out new measures to pay the debt, which gave results, after the current consumption has been paid for, that they have carried out judicial actions aimed at recovering part of the debt old capital (issuing and collecting payment orders, distributing funds for old debts, collecting an amount of at least 392,000 euros per month for old debts ) that, in accordance with the decisions of the general meeting of DEPA SA, I did not choose to cut off the supply of natural gas as a decision, because this would have negative consequences for the activities of DEPA SA, as it would lose the ability to collect through the repayment of inflated debt ELFE SA and that my decisions served the corporate interests and were made after information gathering, risk assessment and weighing reasonable risks in the course of managing the commercial activities of DEPA SA.
