The reorganization of ANAF aims to improve the structure of operational control (General Directorate for Tax Fraud – DGAF) in the fight against tax evasion and fraud.
The Ministry of Finance proposes to return to the use of a public function specific to the anti-fraud structure, namely the function of the anti-fraud inspector “to support and consistently reflect the development of activities with a corresponding change in the legal framework

In accordance with the legal provisions, the control bodies within the framework of the DGAF are permanently at the service’s disposal.
“Thus, this body can quickly intervene through anti-fraud controls when the situation requires it, since it is well known that tax evasion activities are intentional, their perpetrators can act anywhere and everywhere to evade enforcement . fiscal obligations,” the explanatory note says.
It also states that the attributions and data corresponding to the operating system of RO e-Transport and RO e-Seal and taking into account, at the same time, the new legal norms on the prevention and fight against illegal economic activities, is a prerequisite that the number of operational control actions will increase exponentially, as it is necessary to strengthen the position of the personnel who carry out anti-fraud control.
“Special obligations, additional to other general functions within the ANAF, such as permanent provision of service, carrying arms and uniforms, require regulation of some relevant rights through a special statute approved by law,” the document says.
Thus, the MoF shows that professional requirements and integrity requirements can be improved, as well as other important aspects to ensure institutional stability, as prerequisites for optimizing DGAF activities and achieving ANAF’s strategic goal of preventing and combating tax evasion.
According to the project, “the personnel of the Agency within the framework of the General Directorate for Combating Tax Fraud, who hold certain public positions, during their service wear uniforms, identification marks, badges and, depending on the circumstances, weapons and other technical means used as individual means of defense, protection and communication, which are assigned free of charge. When performing official duties, persons holding certain government positions may wear civilian clothes.”
Any anti-fraud enforcement action will involve at least two individuals holding specific government positions used by the Anti-Fraud Directorate-General.
ANAF and customs will receive new vehicles
According to the document, in order to fulfill the duties and missions established by the national RO e-Seal system, ANAF and AVR need appropriate equipment by purchasing vehicles equipped with special equipment and ensuring the functioning of the RO e-National System-Seal on a 24/7 basis .
“At the same time, the vehicle will ensure the performance of other types of control actions on the roads or near the places of economic transactions with goods under customs supervision or excise products, respectively, prompt and safe movement. personnel participating in joint actions with the structures of the Ministry of Internal Affairs and the Ministry of Public Affairs,” the message reads.
The procurement of these vehicles will be done through the centralized system of the Office of National Centralized Procurement (ONAC).
Thus, ANAF and customs can buy cars with a cylinder capacity of more than 1,600 cm3 and the price of which can exceed the counter value in lei of 23,000 euros including VAT.
Furniture and office equipment will also be purchased.
New position of vice president in ANAF
A new position of vice president will be created at the Agency level, which will directly coordinate the institution’s digitalization activities.
The new position will be obtained by abolishing the existing vacancy in ANAF and creating the position of Vice President of ANAF at the rank of Deputy Secretary of State, appointed by decision of the Prime Minister, who will carry out the powers delegated by the President of the Agency. .
The Directorate of Large Taxpayers loses its legal personality
From April 1, 2024, the Main Department of the Administration of Large Taxpayers will function within the National Agency for Fiscal Administration, a fiscal body whose competence is fiscal administration.
The method of reorganization of the Main Directorate for the Administration of Large Taxpayers, the loss of the status of a legal entity and its functioning as a general administration within the National Agency for Fiscal Administration will be achieved through a merger.
The merger will be carried out through the absorption of the Main Directorate for the Administration of Large Taxpayers by the National Agency for Fiscal Administration.
Positions and personnel related to the Main Directorate of the Administration of Large Taxpayers will be accepted on the basis of the protocol, in accordance with the law, to the own apparatus of the National Agency for Fiscal Administration.

Salary entitlements for personnel in units under the Ministry of Finance are aligned with the salary level for positions in the unit under the Ministry of Finance, ANAF. This means that many workers will get a raise.
Civil servants who hold certain public positions in the anti-fraud structure are considered to have experience in their specialty during the entire period during which they carry out their activities in the anti-fraud structure.
Salaries will increase in the National Anti-Money Laundering Office at the ANAF level.
