Spacey was fired from the show’s final season in 2017. Spacey agreed to pay $1 million over several years in installments equal to 10% of his after-tax income. MRC also enlisted Spacey’s cooperation in trying to recover the remaining costs from his insurance company.

In April 2022, MRC sued the Fireman’s Fund and Lloyd’s of London on the theory that Spacey’s absence from the series was covered by their distribution insurance policies. The production obtains distribution insurance to protect itself in case a key actor becomes ill and cannot perform.

In that case, the MRC noted that shortly after Spacey’s alleged misconduct was reported by CNN and other media outlets, he checked into Meadows, an Arizona facility that offers sex addiction treatment. The company argued that this qualifies as a policy-inducing illness.

Epstein dismissed the case against Lloyd’s outright, but allowed the MRC to make another attempt to amend the claim against the Fireman’s Fund. Among other flaws in the lawsuit, the judge noted that the MRC did not specify Spacey’s condition or explain exactly how it would prevent him from acting.
