“The Agreement provides for the principle of equal treatment between persons subject to the Agreement, who live in the territory of one of the contracting states, and citizens of this contracting state when applying legislation regarding the right to receive pensions and their payment. The agreement also provides for the principle of the export of pensions, with the exception of those related to Romania, special cash payments not related to contributions. Provisions are included to establish the applicable legislation on social security, respectively, legislation on social insurance contributions, respectively, social health insurance contributions, general rules according to which a person who carries out his activities as an employed or self-employed person in the territory of a Contracting State is subject, from the point of view of employment or self-employment, only to the laws of that Contracting State, regardless of the person’s place of residence or the location of his headquarters the employer,” says the motivational statement of the project.

According to the document, the Agreement also provides for a number of additional rules for certain categories of employees or self-employed workers.

“Regarding the appointment of a pension, it is also provided for, in the event that a person does not fulfill the conditions for acquiring the right to a pension, the calculation of the insurance length of service. The calculation of pensions is carried out according to the principle of pro-rata temporis (in proportion to the contributions to the system. The executive branch will also discuss in the first reading the draft of the emergency order amending Part 11 of Article I of GEO no. 15/2022 on the provision by the Romanian state of humanitarian support and assistance to foreign citizens or stateless persons in special situations arriving from the zone of armed conflict in Ukraine.

Also, in the first reading, the Government will discuss the draft emergency resolution on the establishment of measures to regulate the import of agricultural products from Ukraine or the Republic of Moldova, as well as the National Strategy for the Protection and Promotion of Children’s Rights “Protected Children”. , Safe Romania” 2023-2027.

Also, the decision will approve the Methodical norms for the application of the provisions of GEO No. 77/2023 regarding the approval of the continuation of the pilot program of providing food assistance to preschoolers and students of 450 state institutions of pre-university education.

In another decision, the Government will approve the allocation of funds from the Reserve Fund of the budget, which are at the disposal of the Government, provided for in the state budget for 2023, to supplement the budget of the Ministry of Investment Project.

According to the explanatory note, the changes provided for in this project provide for the provision of the October tranche of material support in the form of social vouchers for electronic provision in accordance with GEO No. 63/2022 with further changes and additions, as well as the provision of an allowance for teaching careers for teaching and auxiliary teaching staff, as well as professional career allowances for non-teaching staff in public education, in October 2023, in accordance with the provisions of GEO No. 58/2023.

Supplementing the estimate of the Higher Council of Magistracy for the National Institute of Magistracy for 2023 from the reserve fund of the budget at the disposal of the Government provided for in the state budget for 2023, also approve the decision to pay allowances to court auditors and related employer contributions.

The Government will approve the Memorandum on the necessity and possibility of expenditure related to the investment project “Information system for dispensation of GPI branches (SIEC – ATI)”.

Another draft decision, which is subject to the approval of the Government, concerns the expropriation of all privately owned buildings located on an additional plot, the approval of the list of state-owned buildings, as well as the approval of the list of communally owned buildings of administrative-territorial units that are included in the corridor of expropriation of the work of a utility enterprise of national interest “Buzeu-Fokshan Highway”.
