The local administration of the commune of San Martin filed a criminal complaint and notified the National Office of the Cult of Heroes (ONCE), the body responsible for military cemeteries in Romania, about the new cross-placing campaign that took place at the Valia Uzului cemetery. , said the mayor of the commune, Sandor Birtalan, to the Hungarian press agency MTI.

He clarified that as the owner of the territory, which belongs to him from an administrative point of view, on July 10, the commune filed a criminal case with the police against Mihai Tirnoveanu and his supporters. In this document, he reported on the new location of the crosses and the desecration of the military cemetery, events that took place on Saturday, July 8, and demanded that an investigation be opened and the perpetrators brought to justice. The document also reminds that the action of the Calea Neamului organization was planned and organized on social networks, the mayor clarified.

Mihai Tirnoveanu announced on Thursday on his social network page about the audience at the Ministry of Defense that took place during the day with the participation of representatives of the Calea Neamului organization and the Orthodox Brotherhood, who also participated in the recent placement of the crosses, adding that “the discussions were positive.”

“We are starting entry procedures fully legally for the 150 wooden crosses and the Great Memorial Cross from the Vala Uzului International War Cemetery,” Tirnoveanu wrote. The Ministry did not make any statement on this matter.

A lawyer from Cluj, Julia Kish, who was the legal representative of the local administration in San Martin together with the Legal Aid Service for Minorities “Mikó Imre” (MIJSZ), in the case of the previously installed concrete crosses, informed the news portal Maszol. .ro on Thursday that in this case no court or judgment is required to issue a demolition order.

She recalled: in 2019, the Darmenest local council issued administrative documents, on the basis of which the military cemetery was included in the public property of the city, registered in the land register, after which a construction permit was issued, and these procedures were subject to appeal in court.

According to the lawyer, in this case “we are talking about arbitrary actions”, which were not preceded by any administrative act, which “at least imaginary legitimizes” what happened. The organizers and participants have committed a number of crimes for which they can be prosecuted and punished under Law No. 1000. 50/1991 – she told the Maszol portal, adding that the results obtained so far in the Romanian courts could help the commune of San Martin in solving the situation .

On Saturday, July 8, followers of the Calea Neamului organization installed 150 wooden crosses at the international military cemetery to replace the concrete ones removed on June 29. In addition to smaller crosses tied with Romanian tricolor ribbons, there was also a larger cross and a mast on which the Romanian flag flew.

The ownership of the Valia Uzului site and the military cemetery and barracks buildings located on the territory of the village, as well as the Romanian plot in this cemetery, are the subject of countless lawsuits in the courts. Some of these processes were initiated by Sanmartin (Hargit County), others by Darmenest (Bacău County), and others were filed by the prefect of Bacău County.

In April 2019, the local council of Darmenest established a Romanian site at the military cemetery located on the border between the counties of Harghita and Bacău. On June 6, 2019, there were violent incidents between several Hungarians who formed a human chain to prevent Romanians from entering the Heroes’ Cemetery in Vala Uzului to participate in the Heroes’ Day celebrations, and a group of Romanians who forced their way in, prompting the intervention of gendarmes to prevent allow the situation to escalate. Also, during that period, several crosses of some Romanian heroes at the Valia Uzului cemetery were covered with plastic bags.

In early August 2019, the city of Dermaneşti sued the municipality of San Martín to partially overturn the 2007 decision of the local commune council, according to which the Vala Uzului military cemetery and unused former barracks buildings were taken to court. declared public property of the city of Harghita, near the cemetery. The decision of the San Martin local council was also confirmed by Government Resolution no. 299/2010.

In October 2020, the Court of Appeal of Tirgu Mures finally settled the dispute regarding the Vala Uzului military cemetery and finally dismissed the lawsuit by which the city of Darmeneshti sought to annul the decision of the San Martin local council, which transferred the military cemetery in Vala Uzului to the public ownership of the commune.

On June 28, 2023, the concrete crosses installed by the Dermanest City Hall at the cemetery were removed by court order.

On July 8, representatives of the “Calea Neamului” organization installed 150 wooden crosses in place of the removed concrete ones.
