Amendments to the Law on Sports, proposed by the former Minister of Defense Vasile Dinka, received a negative opinion from the Legislative Council on Tuesdayand on Wednesday, the reasoning behind the decision appeared.

Several parliamentarians, led by Vasyl Dinku, the former Minister of Defense, proposed to amend the Law on Sports in such a way that the status of a professional sports club could also be granted to “legal entities under public law, created as a representation of the public. institutions in the field of sports activities”.

“Regarding financing provided by state institutions for the purpose of investing in sports achievements, we note that such financing will probably be considered state aid within the meaning of Art. 107 para. 1 of the Treaty on the Functioning of the European Union (TFEU) and, in order not to be provided illegally, it must be justified in accordance with Art. 107 clause 3 of the contract.

According to the European Commission, the promotion of sports can be a goal of common interest within the meaning of Art. 107 para. 3 letter C of the Federal Law, if amateur sports are supported, rather than professional activities.

If this legislative proposal is adopted, it may even lead to a situation where private law professional clubs participating in the same sporting events together with public law professional clubs will have to pay fees and taxes, while clubs organized as public institutions will benefit from the allocation of budget funds, thereby distorting the competitive environment.

In conclusion, given the above considerations, we understand that this legislative proposal cannot be advanced in the proposed form,” reads the document signed by Florin Iordake, president of the Legislative Council, DigiSport reports.

However, the Legislative Council has only an advisory role, so the parliament can decide to further support the project proposed by Vasyl Dinku.
