Christy Danilec announced on Monday that he won at the High Court of Cassation and Justice the third trial in the CSM regarding his expulsion from the magistracy and will return to his position as a judge in the court of Cluj.

After this decision, Danilets will have to receive the owed salary from December 2021, the date when he was removed from office, until now.

“Today I also won the third case brought by the Judicial Inspectorate, in which I received the sanction of the CCM with suspension from the judges. The Supreme Court found that I did not deserve to be expelled, but only to have my salary reduced (…) I was suspended from my post from December 13, 2021 until today, April 24, 2023. The decision regarding my return to the judiciary is final. I thank my fellow judges and prosecutors who supported me financially during this difficult period for me! I would like to thank my friends from the physical environment and online followers who have been by my side with public appearances and moral support – it was very important!” wrote Danilets on Facebook.

“Accepts for consideration the appeal filed by Danilets Vasylycha Christi against Decision No. 11J of July 20, 2022, issued by the Section for Judges on Disciplinary Cases of the Supreme Court of Ukraine in case No. 4/J/2022. Cancel the contested decision. On the basis of Article 100 letter b) of Law No. 303/2004 on the status of judges and prosecutors, applied to Mr. Danilec Vasylich Christi, a judge of the Cluj court, the disciplinary penalty consists of “a 25% reduction in the gross monthly allowance for 6 months”, according to committing a disciplinary offense provided for in Article 99 letter t) second sentence of the same law. Final,” according to a decision by a five-judge panel of the Supreme Court on Monday, as cited by Agerpres.

Previously, Danylets won two more lawsuits against CSM with the same goal of preventing him from going to trial.

Thus, in February 2023, the Supreme Court annulled the decision of the Supreme Court of Ukraine from May 2022, by which Danilts was removed from judicial power due to the fact that he carried out political activities through two public organizations.

In particular, Danilets was sanctioned because he was a member of two non-governmental organizations that published critical communiqués against the government.

Christy Danilec was also expelled from the CSM Master’s in December 2021 for the manifestations he allegedly had on several social networks. It is about two posts on the TikTok social network, which, according to Danilets, are not about justice, but about private life.

And in this case, Danilets challenged the CSM’s decision in court, winning the case.

The members of the CSM, who expelled Danilec from the magistracy, have meanwhile finished their mandate, and the head of the judicial inspection, the institution that drew up the sanctions protocols, has also left the system.
