
The FRF provided the clarification after Vasile Dinku, the former defense minister, suggested that some amendments to the Law on Physical Education and Sports be urgently discussed in order for CSA Steaua to be eligible for promotion to the Super Lig at the end of this season.
According to current legislation, CSA Steaua can only advance if it changes its form of organization from a club under public law to a non-profit association or joint-stock company.
Another option for the “military” is to amend the Law on Sports no later than a week before the start of the next season.
FRF confirms: Steaua’s CSA could leave if sports law is changed
According to GSP, the Romanian Football Federation clarified that “Steaua” can be promoted if it fulfills one of the above conditions.
“The change in the legal rule which currently prohibits public law clubs from being members of a professional league automatically means that this restriction no longer applies and gives the club concerned the opportunity to participate in Ligue 1 from next season, provided they and all other regulatory conditions are met!
To avoid any doubts, we would like to clearly emphasize that the above answer is valid depending on the final form of the respective rule and the date it enters into force, the Romanian Football Federation cannot influence in any way either of the two mentioned aspects”. – the FRF’s answer for GSP.
As the current paragraphs of Art. 31 of the Law on Physical Education and Sports
(1) Sports clubs organized as joint-stock sports companies are professional sports clubs. The subject of their activity is participation in professional sports competitions, popularization and development of sports activities, as well as other activities related to their social object or derived from it.
(3) Professional sports clubs are subject to the legal regime of commercial companies with the features provided by this law.
Proposal to amend the law
(1) Professional sports clubs are sports structures organized as non-property companies, joint-stock sports companies or legal entities under public lawcreated as representative public institutions in the field of sports activities, which received a license of the national sports federation, issued in accordance with the statutes and regulations of international sports federations.
(3) Professional sports clubs organized as non-proprietary associations are subject to the legal regime of this type of association, to professional sports clubs organized as joint-stock sports companies, the legal regime of commercial companies is applied, with particularities of this law, and professional sports clubs, organized as legal entities under public lawcreated as representative public institutions in the field of sports activities, the legal regime of public institutions within which they operate is applied.
