
They were declared illegal Single Court of First Instance of Athens V strikes which opposed the assessment of civil servants by the five unions.
Court of First Instance ruled that declared strikes are political strikes and they are considered illegal because they are, in essence, trying to suppress the right of the state power to legislate, in fact, in a matter that falls within its exclusive regulatory competence.
In particular, the strike mobilization of the following organizations has been declared illegal on the basis of lawsuits filed by the Greek State on the orders of the Minister of the Interior. Maki Voridis:
The Court of First Instance ruled that the declared strikes, given that refers to the refraining of employees from any activities or procedures related to the evaluation and goal setting process of Law 4940/2022 before its expiration for the evaluation period of 2023, therefore, are invalid.
Also with no. 369/2023 decision of the single court of first instance of Athens, which was issued at the request of the Greek state in accordance with the order of the Ministry of Immigration and Asylum, the declared strike – abstaining from the procedures for assessing the target location “Association of Asylum Service Workers and the Appellate Body of the Ministry of Public Order” was declared illegal and protection of citizens.
Recall that the one-man court of first instance in Athens in a previous decision also declared the strike declared by ADEDY illegal, calling on its members to refrain from the evaluation process.
Minister of the Interior Makis Voridis, commenting on the new decisions of the court, said: “Evaluation-targeting of civil servants is an innovative tool that is aimed primarily at improving the qualifications of the human potential of the public sector, which makes a significant contribution to the reform of public administration. We have taken legal action to ensure that the assessment process continues unhindered. The vast majority of civil servants and Greek society agree with our goal, and we have no intention of giving in to this demand. We have made it clear across the board that the new scoring and targeting system we have implemented will continue to roll out unhindered, despite the objections of some who seek to keep the public administration fixated on the egalitarianism of the left.”
