The Union of Judges and Prosecutors, following recent developments and taking into account the position already expressed that it will not allow the judiciary to become part of the “political game”, points out the following:

A. The judiciary is the backbone of the Republic, and its officials must at all times strive to preserve the principles of justice and protect the freedoms and rights of the individual. The judiciary is deeply democratic and serves democratic institutions with energy, courage and devotion.
B. In a country with strong democratic institutions, such as ours, the legislative initiative belongs to the government, and the legislative function belongs to the legally elected parliament. The principle of the rule of law, enshrined in our Constitution, and also a common value of the European Union, requires a transparent, responsible, democratic and pluralistic law-making process. The fragmentary and schematic nature of the legislation raises suspicions of the arbitrariness of the executive branch.
WITH. The expression of public opinion by a bailiff on the content of the decision, which he will be asked to either comply with or not comply with, is contrary to the principles of impartiality and objectivity, which are a guarantee of a fair judicial decision. . The dialogue between the three functions should take place between these institutional representatives and within the framework provided by the Constitution and laws.
D. General declarations in favor of the rule of law, from whomever they come, are not enough to consolidate this principle, because the challenges that the latter faces in the modern era in the quest for the essentialization of Democracy, social peace and the preservation of freedom are great.
E. Greek bailiffs are subject only to the Constitution and the laws of the state, they make decisions in accordance with their conscience, and the decisions they make are in accordance with the principle of legality.
