In the same material, Tel Drum was sentenced to pay a criminal fine of 240,000 lei for the commission of a crime related to the use or dishonest provision of false, inaccurate or incomplete documents or statements, if the action led to the illegal receipt of funds from the general budget EU or from budgets administered by it or on its behalf.

In addition, “Tel Drum” is prohibited from participating in public procurement procedures for a period of 2 years.

The same provisions were applied in the case of WFA Impex SRL – a fine of 240,000 lei and a ban on public auctions for two years.

On the other hand, the court satisfied the civil claim of the Ministry of Regional Development and decided to jointly oblige the defendants and both companies to pay damages in the amount of 4,849,375 lei.

The ban on initiating the dissolution or liquidation procedure of Tel Drum company, adopted by the Bucharest Court in 2018, was also preserved.

The decision is not final and may be appealed.

According to DNA, in 2015, the Ministry of European Funds accepted a project proposed by Tel Drum as part of the “Increasing the Competitiveness of the Economy” program financed from European funds. As part of the project, Tel Drum SA was supposed to acquire a “mobile station of asphalt concrete mixes to increase the economic competitiveness of SC Tel Drum SA”. The project was to be implemented by December 31, 2015.

On September 2, 2015, Tel Drum SA published an announcement on the website www.fonduri-ue.ro for the purchase of goods (mobile station) and after the stages of the procedure for concluding a contract for the supply of goods, WFA Impex SRL was declared the winner. After submitting a reimbursement request in February 2016, the beneficiary Tel Drum SA received a grant of 4,849,375 lei under the project, an amount close to the maximum acceptable value, the majority of which, namely 4,170,462 lei, comes from European funds.

The prosecutors claim that the representatives of Tel Drum – Mircea Višan, Petre Pišan and Neda Florea – and the representative of WFA Impex SRL – Ion Florian – violated, on the one hand, the rules regarding the execution of the procedure for awarding the supply contract and, on the other hand, they drew up documents confirming unrealistic facts and circumstances (documents for which non-refundable funds were subsequently received).

That is, they modeled the award procedure, the representatives of Tel Drum SA were actually the ones who negotiated the price and terms of the equipment purchase from the supplier company, while WFA Impex SRL was only a spiritual interlocutor in the procedure (this company had neither the experience nor the ability to supply equipment) and, on the other hand, they provided WFA Impex SRL with information on the progress of the project, conditions of participation and technical documentation before the publication of the request notice. for suggestions.

Thus, the competitive nature of the award procedure was eliminated and they drew up and submitted declarations of no conflict of interest between the representatives of the beneficiary and the tenderer, although WFA Impex SRL was affiliated with Tel Drum SA, and between Petre Pitis, Neda Florea and Ion Florian had as professional as well as personal relationship, the company operated as a satellite company of Tel Drum SA.

In addition, DNA shows that they would have unduly increased the value of the total estimate submitted by WFA Impex SRL, Tel Drum SA, by agreeing to pay the amount of 200,000 lei without VAT for the development of the land, even though the land had already been developed and secured. , an amount of 560,000 lei for installation assistance (although this was done under the direction of the main supplier and with the participation of Tel Drum SA employees) and an amount of 871,840 lei for miscellaneous and unforeseen expenses.

He would draw up the minutes of the award procedure and the accompanying award note, knowing that the award process was being simulated and that there was a conflict of interest in this matter that could lead to the elimination of the bidder WFA Impex SRL from the procurement procedure (the minutes that were used as supporting documents for the claim for compensation) and would draw up acceptance-handover, acceptance and commissioning protocols, recording unrealistic aspects in their content, although at the time of drawing up the documents the machine was not fully assembled and was not put into operation (the protocol was used as accompanying documents for a claim for compensation).

Liviu Dragnia was sent to court in a separate case against the company Tel Drum for fraud in contracts financed from public funds (national and European).
