What was provided for by General Administrative Law No. 13 for abuse of official position

  • (1) Actions of a civil servant who, during the performance of his official duties, knowingly committed actions that violate some provisions espresso the law, order or emergency order of the Government or does not perform the prescribed act clear provisions by law, order or emergency order of the Government and because of that to cause harm material over 200,000 lei or serious injury, certain and effective rights or legal interests of an individual or legal entityaccording to the current legislation, is punishable by imprisonment for a term of 6 months to 3 years or a fine.
  • (2) The action of a civil servant, which during the performance of official duties prevents the exercise of a person’s right or creates a position of inferiority for him on the basis of race, nationality, ethnic origin, language, religion, gender, sexuality. orientation, political affiliation, wealth, age, disability, non-communicable chronic disease or HIV/AIDS shall be punished by imprisonment from one month to one year or a fine.

What does the PSD-PNL-UDMR amendment provide for

  • (1) Actions of a civil servant who, while performing his duties, knowingly did not perform an action prescribed by law, government order, or emergency government order. or another normative act that had the force of law on the day of its adoption or performs in violation of the provisions contained in such regulatory act, thereby causing even more damage or equal to 250,000 lei or serious infringement of the rights or legitimate interests of an individual or legal entity shall be punished by deprivation of liberty for a term of 2 to 7 years with deprivation of the right to hold public office”.
  • (2) Provisions stipulated in par. (1) regarding the condition that the damage is greater than or equal to 250,000 lei, does not apply if the perpetrator has committed another crime in the form of abuse of official position or official negligence within 5 years from the date of the final decision of the courts on sentencing. .
  • (3) By means of the penalty provided for in paragraph (1), it shall also be punished the act of a civil servant who is in the exercise POWERS work, restricts the exercise of a person’s right or creates a situation of inferiority for him based on race, nationality, ethnic origin, language, religion, gender, sexual orientation, political affiliations, financial status, age, disability, chronic absence – infectious disease or HIV/AIDS

A draft amendment to the Criminal Code passed by the Senate on Wednesday sets a value threshold for abuse and neglect in the service. More precisely, if the damage is less than 250,000 lei, i.e. 50,000 euros, then there is no crime.

GEO 13 provided for a value threshold of 200,000 lei.

We recall that the adoption of GEO 13 by the government led by Sorin Grindianu on January 31, 2017 after 21:00 caused the largest street protests recorded in Romania since the revolution.
