The head of the station on duty, who was on duty on the evening shift on the night of the tragedy of the Tempe train, which claimed the lives of 57 passengers, today (03/28/2023) was released on bail at the request of the investigator for special cases. Other permanent stationmasters are also expected to testify for his defence.
Restrictive conditions – every 15 days to report to the police station at the place of residence, not to leave the country and to pay a deposit of 15,000 euros.
Judging by the materials of the case, the head of the station seemed to be obliged to stay until 23:00, as envisaged by shift planning, but allegedly left earlier.
The stationmaster, in his apology, refers to the OSE Rules of the Road, paragraphs of which state that from the moment the next stationmaster takes office, the responsibility lies with him, and not with the previous stationmaster. Thus, he argues, since the next stationmaster arrived at 10:00 pm, he could have left because it was justified by the regulations. The question remains why this assembly was carried out earlier and what this could mean, at a time when the permanent foremen of the station are working the 9-hour shift.
“… Regarding the work schedule of the station chiefs, I have to clarify the following … The total time … exists solely and exclusively to ensure safe delivery – receiving one shift from one station chief to another. No more, no less. The station chief of a new shift arrives .It is updated with the previous one.Receives the favor and signs the book and releases the previous one, which also leaves […] From that moment on, the accepting employee is responsible for the assumed duties until the next change of duties takes place. Despite this, the delivery employee remains responsible for any incomplete or incorrect information that he provided to the receiving employee, and in general for the lack of registration in the movement log … ”the station chief notes in his apologetic note.
It is reminded that on Thursday, March 30, the traffic inspector responsible for the shifts on the fateful night will be released. According to the information, he will claim that he asked for a shift until 23:00. there should be two people. The inspector’s apology will be presented in an 80-page memorandum.
